Reparcelación in Planes del Rei: from planned works to the first payment notices
In 2009, Pratdip Council approves the project to complete the development of Planes del Rei and renew its infrastructure: the water supply network, sewerage and streets. However, arrangements for carrying out the works and sharing the costs between the properties concerned still need to be put in place. This is where the procedure known as reparcelación económica comes in.
From the opening of the procedure to registration at the Land Registry, the following timeline explains how the first payment notices issued in 2026 came about. Our articles on 2008 and 2009 cover the approval of the works project and the difficulties surrounding the agreement.
2010–2011: the council takes charge
On 9 November 2010, the council decides to switch from the compensation system to the cooperation system. These are two ways of organising the development process: under the first, property owners must organise themselves to manage it; under the second, the council takes the lead, with costs shared between the owners concerned.
On 6 July 2011, the council opens the reparcelación procedure. The documentation must identify the properties concerned, clarify their status and determine each property’s share of the costs.
2012: an initial calculation method
In Planes del Rei, where many houses have already been built, the main purpose of economic reparcelación is to share out the costs. It also allows corrections to property descriptions, areas or boundaries, and regularises the status of land intended for public use.
The project assigns each property a participation coefficient: a percentage used to calculate its share of the costs.
The explanatory document accompanying the 2012 project sets out the method used. For residential properties, the coefficient is calculated from the land area taken into account in the project, rather than the size of the house.
The 2012 version provides for special rules for some land where the permitted use is not residential. It also proposes exempting certain land used for public services. The complete documentation given final approval in 2022 is still needed to check which rules were ultimately adopted.
The 2012 version estimates the costs at around €7.27 million, including VAT. This is the estimate made at the time; it does not establish what the works would cost today.
Following an initial approval, the documentation is supplemented to clarify the estimated costs and how they are to be shared. The expanded version receives a second initial approval on 15 March 2012, followed by final approval on 11 July that year.
2015–2018: the project is revised
The 2012 approval does not bring the process to an end. Amendments are made and challenges follow.
A version known as the “second consolidated text” receives initial approval on 15 April 2015 and final approval on 4 January 2018. A consolidated text brings the project and its amendments together in one document. This version changes, among other things, the descriptions and boundaries of certain properties.
The decision is published in the Official Gazette of the Province of Tarragona, known as the BOPT, on 16 March 2018.
2021–2022: a further amendment is approved
In 2021, a further amendment incorporates, among other things, coordinates that allow properties to be located precisely on the plans.
The council gives this amendment initial approval on 28 October 2021. Those affected can then submit comments or objections to the council, known as alegaciones.
On 1 July 2022, the council gives final approval to the amendment. The decision is published in the BOPT on 3 November 2022.
2024: the legal challenge by SOS Planas and other owners
The Asociación de Vecinos de “Les Planes del Rei” (SOS Planas), the residents’ association, and other property owners challenge the decision of 1 July 2022 in court.
According to the summary of their arguments in the judgment, the claimants challenge the need for the economic reparcelación procedure, arguing that the land transfers have already taken place and the infrastructure obligations have already been fulfilled. They also ask the council to bear the costs corresponding to the land transferred to it. The judgment does not specify which transfers or plots of land they are referring to. The council opposes their claim.
On 8 May 2024, Administrative Court No. 2 in Tarragona declares the challenge inadmissible. It considers that, on the points being challenged, the 2022 decision repeats earlier decisions that have become final, and that this challenge cannot be used to reopen them.
Our analysis of the judgment of 8 May 2024 explains the parties’ arguments and the reason for the court’s decision.
2026: Land Registry registration and the first cost contributions
The project is registered at the Land Registry on 28 April 2026. Registration records the transactions provided for in the project and the charges attached to the properties. This is a separate stage from the council’s approval in 2022.
In September 2026, property owners begin receiving notices of an initial contribution towards administrative and professional costs. Our article on the first notices explains this stage.
The council subsequently publishes a decree and an explanatory note clarifying what the costs cover and how payment will be organised. The total being shared out is €357,829.86, including VAT. This covers costs already incurred in processing the project, including technical and legal services, Land Registry formalities and notifications.
The council also clarifies that the initial notice is not a payment demand: the documents needed to make payment will be sent by BASE, the body responsible for collection. Payment is to be made in three instalments. We explain these clarifications in our article on the first amounts to be paid.
This €357,829.86 covers the administrative and professional costs being shared out at this stage. It is not the total cost of the works needed to complete and renew Planes del Rei.
What still needs to be clarified
The available documents allow us to trace the main stages of the procedure. The decree and explanatory note also provide answers about the first administrative and professional costs and their payment.
Two items are still needed to complete the analysis:
- The complete project documentation given final approval in 2022, including the coefficient tables, individual property records and cost estimate;
- The original Land Registry decision refusing registration of the 2012 version. This refusal is mentioned in the 2018 judgment, but the decision itself still needs to be located so that its reasons can be examined in detail.
The 2022 documentation is needed, in particular, to explain precisely how the coefficients are calculated and any differences in how land is treated. The tables allocating the first costs show the percentages applied, but do not, on their own, explain how those percentages were established.
For the administrative and professional costs, the published breakdown still needs to be checked against the supporting documents: services provided, invoices and amounts included. These documents should allow owners to understand what they are funding and how their contribution has been calculated.
A clear explanation of these calculations and straightforward access to supporting documents would help the council answer the questions that remain. After such a lengthy process, property owners should be able to understand the sums they are being asked to pay and distinguish costs already incurred from the cost of future works, which has yet to be clarified.
