The Associació Administrativa de Cooperació of Les Planes del Rei is currently in the process of being established.
At this stage, however, its statutes are not yet final. According to the information provided by Domingo Ripollés on 1 August 2026, the current draft has been submitted to Pratdip Town Council and is still awaiting final approval.
La Tribune de Planas has therefore decided to examine the document as it currently stands and to publish it in full, so that every property owner can read its contents directly.
It is important to stress that this is still a draft set of statutes. Some provisions may still be amended before final approval.
An association intended to support the implementation of PAU-4
The draft defines the AAC as an entity intended to work with Pratdip Town Council on the urban planning measures required to implement the PAU-4 of Les Planes del Rei.
However, the text makes one essential point clear: the association is not intended to carry out the urban development works itself.
It is not responsible for commissioning the works, awarding contracts, supervising them, or taking over their technical or administrative management from the Town Council.
According to the draft, responsibility for carrying out the works therefore remains with Pratdip Town Council.
The Town Council remains central
The draft statutes place the AAC under the administrative supervision of Pratdip Town Council.
Among other things, the Town Council must approve the statutes and any subsequent amendments, approve the establishment of the association, and appoint a municipal representative to sit within it.
Any changes or adaptations to the urban development project also remain the responsibility of the Town Council’s technical services and competent municipal bodies.
The AAC will nevertheless be able to make suggestions, observations and proposals. It will also be able to monitor the progress of the works, report any problems and request information from the Town Council.
Voluntary membership
One of the key points in the draft concerns membership of the association.
Article 6 states that the members of the AAC are property owners within the PAU-4 who choose to join voluntarily.
This voluntary basis is also repeated in Article 9, which states that the association is established on a voluntary basis.
Membership of the AAC is therefore not automatic for all property owners in Les Planes del Rei.
Owners who do not take part in its initial establishment will be able to apply to join within the time limits set once the statutes have been approved.
One property owner, one vote
The draft also establishes an important principle: each member has one vote, regardless of the size of their plot or their financial share.
This means that the owner of a larger plot would not have more voting power than the owner of a smaller one.
For ordinary decisions, resolutions would be adopted by a simple majority of the members present or represented.
How will the AAC be run?
The association will operate mainly through three bodies: the General Assembly, the Junta de Govern and the president.
The Junta de Govern is to be made up of a president, vice-president, secretary, treasurer and four board members.
These positions are expected to be held for a two-year term.
The draft also sets out an election procedure based on lists of seven candidates.
Who will pay for the urban development works?
At this point, it is important to clearly distinguish between financing the works themselves and financing the association’s own running costs.
As regards the PAU-4 urban development works, the draft provides that the amounts to be paid by property owners to finance them will be determined, approved and collected by Pratdip Town Council.
The AAC would therefore not be able to impose or collect from property owners the amounts intended to finance the urban development works.
The draft also provides that the association may review how these funds are used and request explanations from the Town Council in defence of the common interests of its members.
Will the AAC be able to charge membership fees?
Yes, but this is a separate matter.
The association may have its own operating expenses, such as administration, management, possible professional advice or other costs required for its activities.
The draft states that these expenses may be funded through subsidies or public or private contributions.
If these resources are insufficient, the General Assembly may decide to charge ordinary or extraordinary fees to its members.
Under the current draft, these fees would be the same amount for every member, regardless of the size of their property.
What happens in the event of non-payment?
The draft sets out several consequences where a member fails to pay amounts due to the association.
Among other measures, a member in arrears could temporarily lose their voting rights and their right to hold office within the AAC until their situation has been regularised.
Article 30 also provides that, once the relevant deadline has passed, the association may ask the Town Council to initiate the appropriate procedure to recover unpaid amounts.
The AAC will be able to represent its members
The draft provides that the association may represent and defend the common interests of its members before the Town Council, other public authorities, the courts or private individuals in matters relating to the urban development of PAU-4.
It will also be able to request information about the use of funds intended for the works and submit observations or objections to the Town Council.
However, it is important to distinguish clearly between members of the AAC and all property owners in Les Planes del Rei. An association made up of owners who join voluntarily does not automatically represent every property owner in the development.
Some points still need clarification
A reading of the draft reveals several points that will probably need to be clarified or corrected before final approval.
This applies, for example, to the rules governing amendments to the statutes.
Article 8 states that an amendment requires the approval of members representing at least 60% of the participation in the association.
Article 18, on the other hand, states that amendments to the statutes require an absolute majority of the total number of members.
These two provisions do not appear to be entirely consistent and will need to be clarified in the final version.
The document also contains a number of formal errors or inconsistencies, particularly in the numbering of certain articles and chapters.
All of this is a reminder that this is still a draft and not the final approved text.
Why publish this document?
This draft already gives a clearer picture of how the future AAC of Les Planes del Rei may operate, what its role and limits may be, how it will relate to the Town Council, and what rights and obligations its members may have.
This is a matter that directly concerns property owners. Everyone should therefore be able to consult the original document and form their own opinion.
For this reason, La Tribune de Planas is publishing below the full version of the draft statutes currently available.
Once the statutes have received final approval from Pratdip Town Council, La Tribune de Planas will examine the final version and highlight any differences from the draft published here.
