On 6 July 2011, Pratdip Town Council takes a further step in the Planes del Rei case: it decides to officially open the reparcelación procedure for the PAU-4 urban planning sector, which corresponds to Planes del Rei.
This decision follows the change to the cooperation system, finally approved in November 2010. Under this system, the Town Council oversees the measures needed to complete the development, while the owners concerned remain responsible for financing them.
The reparcelación procedure is intended to identify precisely the properties concerned and distribute among them the rights and costs arising from the development process.
The reparcelación procedure is officially opened
On 6 July 2011, Pratdip Town Council approves the opening of the PAU-4 reparcelación procedure.
This is not yet the final approval of how the rights and costs will be distributed among the owners. The decision opens the administrative procedure that will lead to this distribution.
Among other things, the reparcelación is intended to regularise the configuration of the properties and ensure an equitable distribution among the owners of the benefits and costs arising from the urban development process.
The owners must be informed
The decision provides that the owners concerned must be formally notified that the procedure has been opened.
At the same time, the file must be made available for public consultation. During this period, it can be examined and objections may be submitted before the procedure continues.
The Town Council also asks the Land Registry to provide the necessary certificates concerning the properties included within the reparcelación area.
Some licences are temporarily suspended
While the procedure is under way, certain licences concerning land included in the reparcelación cannot be granted.
This suspension is to end once the final approval of the reparcelación becomes enforceable.
A further step after the change of system in 2010
This decision follows directly from the adoption of the cooperation system in 2010.
The change to the cooperation system had given the Town Council a central role in overseeing the process. The decision of 6 July 2011 now opens the procedure intended to determine precisely which properties are concerned and how the rights and costs are to be distributed among them.
The procedure will continue in 2012: the reparcelación project will receive a new initial approval in March, followed by final approval in July.
But this approval would not bring the process to an end: in December 2012, the registration of the reparcelación with the Falset Land Registry would encounter an obstacle.
