Following the official opening of the procedure in July 2011, the Planes del Rei reparcelación project went through several important stages in 2012.

In March, Pratdip Town Council gave initial approval to a new version of the project. Following a period of public consultation and consideration of the objections submitted, the reparcelación project received final approval on 11 July 2012.

But this approval is not enough to complete the procedure: the project still has to be registered with the Falset Land Registry.


A new initial approval in March 2012

On 1 and 15 March 2012, Pratdip Town Council gave initial approval to the economic reparcelación project for the PAU-4 urban planning sector, corresponding to Planes del Rei.

The project was then submitted to public consultation and the parties concerned were notified. Several objections were submitted during this period.

Among other things, the project had to determine which properties were included in the reparcelación and how the rights and costs arising from the development process would be distributed among them.


The project receives final approval on 11 July

After considering the objections, on 11 July 2012 the Town Council granted final approval to the economic reparcelación project for Planes del Rei.

The document incorporated the changes resulting from objections that had been accepted in full or in part. The decision was to be notified to the parties concerned and published in the Official Gazette of the Province of Tarragona and the Official Journal of the Government of Catalonia.

The Town Council also provided for the decision to be sent to the Falset Land Registry so that the project could be registered once it became enforceable.


The project becomes final at administrative level

Following this approval, a single administrative appeal was lodged. It was resolved on 5 November 2012.

The project then became final at administrative level. However, one essential step still remained: its registration with the Land Registry.


Registration with the Falset Land Registry is blocked

The registration did not go ahead.

A later municipal document states that the Falset Land Registry issued a negative assessment on 28 December 2012.

The same document states that material errors had been identified in the description of certain properties and their boundaries. It also mentions that some registered title holders had not been notified.


The reparcelación project must be corrected

The Land Registry’s decision did not require the entire procedure to start again, but it prevented the project approved in July 2012 from being registered in the form in which it then stood.

Following this negative assessment and discussions with the Falset Land Registry, the project therefore had to be corrected and a new consolidated version prepared.

Thus, 2012 ended in an unusual situation: the Planes del Rei reparcelación had been approved by the Town Council and had become final at administrative level, but it could not yet be registered with the Land Registry.

This blockage explains why the reparcelación process continued for several more years and led to further versions of the project.
