Court Response to Our Criminal Complaint

A legal procedure that is moving forward…

Dear members, dear supporters, dear property owners of Planas del Rey,

Thanks to your continuous support since 2011, your membership contributions, and the outstanding commitment of our association’s board, we were able to file, at the end of January, a criminal complaint against the Mayor of Pratdip, Joan Maria Rovira Vernet, and the municipal Secretary, Izaskun Larroya Robert.

On behalf of our association, the Asociación de Vecinos de Planes del Rei (AVPR), our lawyer invoked three specific offenses:

Offense related to land-use planning and urban development, under Article 320.1 of the Penal Code
Offense of public officials’ misconduct, under Article 404 of the Penal Code
Offense of disobedience and denial of assistance, under Article 410.1 of the Penal Code

Good news: the court has accepted our complaint. The Tribunal has ruled it admissible and summoned the two defendants for a hearing on July 4, 2022.

A worrying attitude from Pratdip Town Hall

Several other elements confirm the seriousness of the situation:

Despite a clear court order, the Town Hall still has not proceeded with the liquidation of the EUCC.
It has not even bothered to collect the registered letter from the Court.

Faced with this inaction, the judges appear to be losing patience. Below is a key excerpt from the latest court decision:

“Visto el estado de las actuaciones, el requerimiento efectuado por éste Juzgado a la representación procesal entonces de la Entidad Urbanística Colaboradora de Conservación de la Urbanización Planas del Rey y los problemas que se están teniendo para la recepción del requerimiento de forma directa por la citada Entidad Urbanística Colaboradora de Conservación, atendido que el Ayuntamiento de Pratdip forma parte de la misma y tiene la función de tutelar sobre la misma, requiérasele a fin de que en el plazo de 1 mes informe a éste Juzgado si tiene constancia de la creación del órgano de liquidación y del inicio de la misma, tal como se acordó en auto de fecha 14-02-2022 en incidente de ejecución n.º 93/21, dimanante de éste ejecución.”

This court ruling is significant: it clearly confirms that the Town Hall of Pratdip holds administrative authority over the now-defunct EUCC. A reality the Town Hall has always denied, but that the Court clearly acknowledges.
