On October 10, 1994, the president of the EUCC Les Planes del Rei sent an official letter to the Mayor of Pratdip. It was a reminder of the request made on March 8, 1994 (entry register no. 214), which had remained unanswered.
1) Context
- The initial request of March 8, 1994 concerned the transfer of the green areas and facilities of the urbanization to the municipality.
- This transfer had been required by the Generalitat of Catalonia on July 24, 1986.
- The ruling of the Falset Court on November 23, 1993 obliged the creditors’ committee of Francis Lebasque to carry out this transfer.
2) Purpose of the letter
- Noting the lack of response from the municipality to the request of March 8, 1994.
- Explicit request for a prompt reply, in order to finalize the transfer before a notary.
3) Analysis
- This letter confirms that, as early as 1994, the municipality had been asked to regularize the situation and take over the public spaces.
- It highlights the municipality’s persistent inaction, in contradiction with clear obligations set by the Generalitat and the courts.
- The absence of an official transfer of the areas allowed the municipality to wrongly justify the refusal to grant the minimum services to Planas del Rey.
4) Current significance
This document constitutes further evidence that the Municipality of Pratdip has failed to comply with its legal obligations for more than 30 years.
It shows that the legal conditions were already in place in 1993 to integrate the urbanization and provide essential services.
