On 21 September 1968, the developer of the Planas del Rey (Planes del Rei) urbanization, Francisco Lebasque Belloncle, sent a formal request to the Pratdip Town Hall to transfer the roads, networks, and shared services of the urbanization to the municipality, in order to improve administration and the provision of public services.

1) Context and nature of the document

  • Official letter from the developer to the Town Hall, written at the request of the property owners of the urbanization and in the interest of better management.
  • Purpose: offer to transfer the infrastructures and shared services to the municipality.

2) Scope of the proposed transfer

  • Roads of the urbanization (viales).
  • Water supply networks.
  • Sewerage networks.
  • Public lighting.
  • Waste collection.
  • Guarding and surveillance.
  • And, more broadly, any service under municipal responsibility.

3) Conditions set by the developer

  • Providing the Town Hall with any additional documentation deemed necessary.
  • Handing over the list of property owners and assets located in the urbanization.
  • Providing the maintenance and service accounts from previous years, for claim and recovery by the Town Hall, followed by a settlement with the developer.
  • Drinking water: the Town Hall may use the existing channel up to the main tank included in the transferred network, until the official reception of the urbanization by the municipality is completed.

4) Legal and urban planning analysis

This letter constitutes a formal offer to transfer public infrastructures and services to the municipality. It follows the logic of municipal reception of urbanization works, a necessary step for the Town Hall to take charge of the services.

  • Scope: if accepted, the municipality becomes responsible for road maintenance and provision of the listed services.
  • Limit of the document: the letter does not prove the acceptance of the transfer by the Town Hall. Taking over responsibility required a formal decision (municipal agreement, administrative act, and/or notarized formalization).
  • Consequence: in the absence of formal acceptance/reception, the Town Hall’s obligations were not automatically triggered as of 21/09/1968.

5) Significant excerpt (original in Spanish)

“… es su propósito hacer cesión de la vialidad general y servicios públicos al Ayuntamiento de Pratdip … a viales de la urbanización, redes de abastecimiento de aguas, redes de desagües, alumbrado público, servicio de recogida de basuras, guardería y vigilancia; además, servicios de la competencia municipal …”

Conclusion

The document dated 21 September 1968 confirms that a global transfer of the infrastructures and services of Planas del Rey was proposed to the Pratdip Town Hall by the developer, on behalf of the property owners. However, to establish effective municipal responsibility starting in 1968, it is necessary to find the act of acceptance (municipal resolution, publication, notarized deed, or urbanization register) confirming the reception of these works.
