On March 31, 2021, at the request of the Municipality of Pratdip, the architect of the Consell Comarcal del Baix Camp issued a technical report on the advisability of the municipal reception of the facilities area of the Planes del Rei urbanization (swimming pools, sports and recreational area, parking and green space). The document concludes on the viability and appropriateness of this partial reception, without prejudice to the overall re-urbanization of the sector.
1) Land and planning data
- Location: Avinguda de Pratdip s/n – cadastral reference 3741626CF2434S0001AB.
- Classification: urban land, included in PAU4, classified as facilities system (Clau Ep).
- POUM: approved on 10/30/2008, revised text on 07/03/2009, published in the DOGC on 02/09/2010.
2) Facilities area concerned
- Swimming pools in service.
- Sports area with tennis courts.
- Large green area with children’s playground.
- Adjacent parking.
3) Management context and transfers
- Cooperation management of PAU4: the initiative for urbanization works lies with the municipality, at the owners’ expense (article 120 TRLUC).
- Reparcelación project: definitively approved, pending registration in the Property Registry of Falset.
- Transfers: roads, green areas and facilities already handed over to the municipality.
- Since the dissolution of the EUCC, the municipality has already ensured minimal maintenance (summer opening and swimming pool safety).
4) Condition and technical implications
- Consolidated and operational facilities, requiring only regular maintenance.
- The overall urbanization project does not include further works for this area, already functional.
5) Legal assessment
- The partial reception does not contravene article 122 of the TRLUC on the financing of urbanization works.
- The owners have fulfilled their obligations by handing over fully operational and well-maintained spaces.
6) Conclusion
- The reception by the Municipality of Pratdip is considered viable and appropriate.
- It ensures the safety, health and maintenance of services of public interest.
- This reception does not hinder the overall re-urbanization of PAU4 nor its future definitive reception.
