On June 21, 2024, the Property Registry of Falset issued a nota simple informativa concerning finca n°1169, located in the municipality of Pratdip, corresponding to the urbanisation Planas del Rey. The document sets out the legal situation, ownership, and charges affecting this plot, including the sports areas and roads.


1) Description of the finca

  • Location: Municipality of Pratdip, “Las Planas” district, today the urbanisation Planas del Rey.
  • Surface area: 3 hectares, 75 ares, 51 centiares after various segregations.
  • Facilities: sports area including an Olympic swimming pool, children’s pool, five tennis courts, gardens, walkways, and parking areas.
  • Purpose: the surface area is distributed among the roads of the urbanisation and common facilities.

2) Ownership

  • Owner: Municipality of Pratdip, NIF P4312000E.
  • Acquisition method: Transfer authorised by the Court of First Instance n°1 of Falset (Protocol n°195 of 24/12/2001).
  • Registration: 4th registration, Volume 943, Book 36, Folio 223, dated 13/03/2002.

3) Charges and easements

  • Real and perpetual easement: the sports facilities, roads, water supply and sewerage networks are subject to use by all the plots in the urbanisation (notarial deed of 13/08/1968, registration 27/08/1968).
  • Observations: the finca was the subject of a judicial agreement accepted by its creditors in 1973; it also benefited from temporary tax exemptions (2002).

4) Consequences and scope

  • The registry certifies that the Municipality of Pratdip has been the official owner of the finca since 2002.
  • Contrary to what the municipality has often claimed, there is no mention of an EUCC or an Entidad Colaboradora Urbanística in this document.
  • This situation demonstrates that the municipality is legally responsible for the common infrastructures of Planas del Rey, by virtue of the property registry entry.
