29 October 2001: Enforcement of the 1993 judgment by the Juzgado de Primera Instancia No. 1 of Falset

On 29 October 2001, the Juzgado de Primera Instancia No. 1 of Falset (procedure of ejecución de títulos judiciales 195/2001) issued an auto ordering the enforcement of the judgment of 23 November 1993 (juicio de menor cuantía 12/90) concerning the urbanization Planas del Rey (Planes del Rei).
Judge Victoria Gallego Martínez “deemed issued” the declaration of will of the developer in order to complete the free transfer of the common assets to the Town Hall of Pratdip, pursuant to Article 708 of the Ley de Enjuiciamiento Civil.

2) Purpose of the judgment

To enforce the 1993 judgment which ordered the developer to transfer free of charge to the municipality the infrastructures and common facilities of Planas del Rey.

3) Content of the decision

  • Capacity and legitimacy of the EUCC recognized; jurisdiction confirmed.
  • Enforceable title: the 1993 judgment meets the conditions of Art. 517 LEC.

  • The public lighting.

These assets are considered transferred free of charge to the Town Hall of Pratdip, even without the developer’s signature.

5) Procedural follow-up

  • Notification and issuance of a mandamiento to the Property Registry of Falset for the corresponding annotations.
  • Request to the EUCC’s representative to provide a notification address for Mr. Lebasque.

The judgment of 29/10/2001 definitively enforces that of 23/11/1993: the transfer of the collective facilities of Planas del Rey to the Town Hall of Pratdip is legally perfected, with the developer’s declaration of will being deemed issued by judicial decision.
