De klacht stelt <span class=\"accentue\">stedenbouwkundige onregelmatigheden<\/span>, feiten van <span class=\"accentue\">prevaricaci\u00f3n<\/span> (ambtsmisbruik) en <span class=\"accentue\">ongehoorzaamheid<\/span> aan de kaak in verband met het <span class=\"accentue\">reparcelaci\u00f3n<\/span>-project van het <span class=\"accentue\">PAU 4 \u2013 Planas\/Planes del Rei<\/span>.<\/p>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>1) Betrokkenen en context<\/h2>\n<ul>\n<li><span class=\"accentue\">Betrokken personen<\/span>: <span class=\"accentue\">Joan Maria Rovira Vernet<\/span> (burgemeester) en <span class=\"accentue\">Izaskun Larroya Robert<\/span> (secretaris-interventor), evenals elke andere natuurlijke of rechtspersoon die verantwoordelijk kan worden gesteld.<\/li>\n<li><span class=\"accentue\">Context<\/span>: sinds <span class=\"accentue\">2012<\/span> probeert de gemeente een <span class=\"accentue\">reparcelaci\u00f3n-project<\/span> voor het <span class=\"accentue\">PAU 4<\/span> opnieuw op te starten, dat systematisch werd aangevochten en geweigerd door het <span class=\"accentue\">Kadaster van Falset<\/span>. Laatste publicatie: <span class=\"accentue\">14 december 2021<\/span> in het <span class=\"accentue\">BOP van Tarragona<\/span> (\u00abModificaci\u00f3n del 2\u00ba Texto Refundido del Proyecto de Reparcelaci\u00f3n Econ\u00f3mica\u00bb).<\/li>\n<\/ul>\n<h2>2) Ingeroepen rechtsgronden<\/h2>\n<ul>\n<li><span class=\"accentue\">Art. 320.1 CP<\/span> \u2013 Misdrijf tegen de <span class=\"accentue\">ruimtelijke ordening en stedenbouw<\/span> (goedkeuringen of vergunningen in strijd met de normen).<\/li>\n<li><span class=\"accentue\">Art. 404 CP<\/span> \u2013 <span class=\"accentue\">Prevaricaci\u00f3n<\/span> (ambtsmisbruik: willekeurige en onrechtvaardige beslissing met kennis van zaken).<\/li>\n<li><span class=\"accentue\">Art. 410.1 CP<\/span> \u2013 <span class=\"accentue\">Ongehoorzaamheid en weigering tot bijstand<\/span> (weigering om <span class=\"accentue\">gerechtelijke uitspraken<\/span> of bestuurlijke bevelen uit te voeren).<\/li>\n<\/ul>\n<h2>3) Feiten en onregelmatigheden aangeklaagd<\/h2>\n<ul>\n<li><span class=\"accentue\">Herhaald niet-uitvoeren<\/span> van vonnissen en beslissingen die gunstig waren voor de eigenaars en de vereniging.<\/li>\n<li><span class=\"accentue\">Onregelmatige publicatie<\/span> in het <span class=\"accentue\">BOP (14\/12\/2021)<\/span> van het <span class=\"accentue\">2\u00ba Texto Refundido<\/span> van de reparcelaci\u00f3n.<\/li>\n<li><span class=\"accentue\">Geen individuele kennisgeving<\/span> aan de eigenaars binnen de wettelijke termijnen (brieven verstuurd pas op <span class=\"accentue\">12 januari 2022<\/span>).<\/li>\n<li><span class=\"accentue\">Valse vermelding<\/span> van een <span class=\"accentue\">EUCC actief<\/span>, terwijl de <span class=\"accentue\">ontbinding<\/span> werd bevestigd door het <span class=\"accentue\">TSJC op 21\/07\/2016<\/span>.<\/li>\n<li><span class=\"accentue\">Overdrachten en ontvangsten<\/span>: groenzones, wegen en voorzieningen (zwembad, openbare ruimten) reeds <span class=\"accentue\">gerealiseerd en aanvaard<\/span>, zoals bevestigd door het <span class=\"accentue\">gemeentelijk rapport van 31\/03\/2021<\/span> (urbanisatie \u00ab<span class=\"accentue\">volledig geconsolideerd<\/span>\u00bb, enkel onderhoud).<\/li>\n<li><span class=\"accentue\">Onwettige kostenverdeling<\/span>: totale kost <span class=\"accentue\">7.212.552,78 \u20ac<\/span>. Volgens <span class=\"accentue\">art. 139 TRLUC<\/span> (systeem van samenwerking): <span class=\"accentue\">44,9 %<\/span> (\u2248 3,2 M\u20ac) ten laste van de gemeente, <span class=\"accentue\">55,1 %<\/span> (\u2248 3,97 M\u20ac) voor de eigenaars. Deze regel werd niet correct toegepast.<\/li>\n<li><span class=\"accentue\">Schending van art. 140 TRLUC<\/span>: het initiatief van het project had toekomen aan de eigenaars (>50 % van de oppervlakten), wat niet werd gerespecteerd.<\/li>\n<\/ul>\n<h2>4) Verzoeken van de vereniging<\/h2>\n<ul>\n<li><span class=\"accentue\">Art. 320.1 CP<\/span> \u2013 Veroordeling tot <span class=\"accentue\">3 jaar gevangenisstraf<\/span> + <span class=\"accentue\">boete 7.200 \u20ac<\/span> (24 maanden aan 10 \u20ac\/dag).<\/li>\n<li><span class=\"accentue\">Art. 404 CP<\/span> \u2013 Prevaricaci\u00f3n: <span class=\"accentue\">10 jaar ontzetting<\/span> uit openbaar ambt en passief kiesrecht.<\/li>\n<li><span class=\"accentue\">Art. 410.1 CP<\/span> \u2013 Ongehoorzaamheid: <span class=\"accentue\">2 jaar ontzetting<\/span> + <span class=\"accentue\">boete 3.600 \u20ac<\/span> (12 maanden aan 10 \u20ac\/dag).<\/li>\n<li><span class=\"accentue\">Schadevergoeding<\/span>: <span class=\"accentue\">hoofdelijke betaling<\/span> van <span class=\"accentue\">50.000 \u20ac<\/span> voor schade en verliezen.<\/li>\n<\/ul>\n<h2>5) Belangrijkste punten om te onthouden<\/h2>\n<ul>\n<li>De rechtbank erkent de <span class=\"accentue\">juridische stevigheid<\/span> van de argumenten en opent de <span class=\"accentue\">onderzoeksfase<\/span>.<\/li>\n<li>De beschuldigingen betreffen een vermeend geval van <span class=\"accentue\">stedenbouwkundige fraude<\/span> rond het <span class=\"accentue\">PAU 4<\/span>, gebaseerd op <span class=\"accentue\">procedurele onregelmatigheden<\/span> en een <span class=\"accentue\">onrechtmatige kostenverdeling<\/span>.<\/li>\n<li>Het <span class=\"accentue\">gemeentelijk rapport van 31\/03\/2021<\/span> en de <span class=\"accentue\">definitieve ontbinding van de EUCC (TSJC 21\/07\/2016)<\/span> spreken de logica van het gewijzigde reparcelaci\u00f3n-project rechtstreeks tegen.<\/li>\n<\/ul>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h3 class=\"underline\">Document<\/h3>\n<p style=\"padding-top: 30px;\"><a href=\"https:\/\/www.latribunedeplanas.com\/wp-content\/uploads\/2025\/06\/2022-01-12-reponse-du-tribunal-suite-a-notre-plainte-au-penal.pdf\" class=\"pdfemb-viewer\" style=\"\" data-width=\"max\" data-height=\"max\" data-mobile-width=\"0\"  data-scrollbar=\"none\" data-download=\"on\" data-tracking=\"on\" data-newwindow=\"on\" data-pagetextbox=\"off\" data-scrolltotop=\"off\" data-startzoom=\"100\" data-startfpzoom=\"100\" data-toolbar=\"top\" data-toolbar-fixed=\"off\">2022-01-12-reponse-du-tribunal-suite-a-notre-plainte-au-penal<br\/><\/a><\/p>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][\/et_pb_section]<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Op 12 januari 2022 heeft de Juzgado de Instrucci\u00f3n nr. 4 van Reus de strafklacht ontvankelijk verklaard die de Asociaci\u00f3n de Vecinos \u00abLes Planes del Rei\u00bb (SOS Planas) heeft ingediend tegen verantwoordelijken van de gemeente Pratdip.
