Dit document formaliseert de oprichting van de entiteit, van <span class=\"accentue\">verplicht<\/span> karakter voor alle eigenaars, en draagt aan de bewoners de verplichtingen over inzake behoud en onderhoud van de gemeenschappelijke voorzieningen.<\/p>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>1) Aard en oprichting<\/h2>\n<ul>\n<li>Administratieve vereniging van eigenaars, met <span class=\"accentue\">juridisch-administratief<\/span> karakter, gebaseerd op de artikelen 24 tot 30 en 67 tot 70 van het Reglement van stedelijk beheer (Wet op de Grond van 1978).<\/li>\n<li><span class=\"accentue\">Verplichte<\/span> deelname van alle eigenaars (art. 25.3 en 68 van het reglement).<\/li>\n<li><span class=\"accentue\">Onbepaalde<\/span> duur, behalve ontbinding door de Algemene Vergadering en offici\u00eble overname door de gemeente.<\/li>\n<\/ul>\n<h2>2) Doel en functies<\/h2>\n<ul>\n<li><span class=\"accentue\">Behoud, onderhoud en gebruik<\/span> van gemeenschappelijke diensten (wegen, verlichting, groenzones, voorzieningen).<\/li>\n<li>Mogelijkheid om nieuwe diensten te cre\u00ebren met gemeentelijke toestemming.<\/li>\n<li>Vertegenwoordiging van eigenaars tegenover de Staat, de Generalitat, de gemeente en de rechtbanken.<\/li>\n<li>Bemiddeling bij conflicten tussen eigenaars.<\/li>\n<li>Gemeenschappelijke elementen die niet aan de gemeente zijn overgedragen, blijven ten laste van de eigenaars.<\/li>\n<\/ul>\n<h2>3) Eigendom en verplichtingen<\/h2>\n<ul>\n<li>Volledig eigendom van percelen door hun houders, maar binnen de grenzen van het Partieel Plan.<\/li>\n<li>Priv\u00e9werken enkel toegestaan met de goedkeuring van de <span class=\"accentue\">Consejo Rector<\/span>.<\/li>\n<li>De gemeenschappelijke elementen zijn <span class=\"accentue\">ondeelbaar<\/span> en verbonden aan elk priv\u00e9-eigendom.<\/li>\n<li>Bij verkoop wordt de koper automatisch <span class=\"accentue\">gesubrogeerd<\/span> in de rechten en verplichtingen.<\/li>\n<\/ul>\n<h2>4) Financiering<\/h2>\n<ul>\n<li>Elke eigenaar draagt bij in verhouding tot de oppervlakte van zijn perceel.<\/li>\n<li>Winkels en restaurants betalen een drievoudige co\u00ebffici\u00ebnt.<\/li>\n<li>Sancties bij niet-betaling: nalatigheidsinteresten, tijdelijke uitsluiting van diensten, afsluiting van water, gerechtelijke stappen.<\/li>\n<li>De EUCC kan de <span class=\"accentue\">Gemeente Pratdip<\/span> vragen de schulden te innen via administratieve dwang (art. 70 van het Reglement van 1978).<\/li>\n<\/ul>\n<h2>5) Organisatie en bestuur<\/h2>\n<ul>\n<li><span class=\"accentue\">Algemene Vergadering<\/span>: jaarlijkse bijeenkomst in augustus, soeverein orgaan van de entiteit.<\/li>\n<li><span class=\"accentue\">Consejo Rector<\/span>: minstens 9 leden, mandaat van 3 jaar, herroepbaar door de Vergadering.<\/li>\n<li>Bestuur: Voorzitter, Vicevoorzitter, Secretaris, Penningmeester.<\/li>\n<li>Bevoegdheden: uitvoering van beslissingen, beheer van diensten, sancties, juridische vertegenwoordiging, aanwerving van personeel.<\/li>\n<\/ul>\n<h2>6) Rechten en verplichtingen van de eigenaars<\/h2>\n<ul>\n<li>Verplichting om lid te zijn van de EUCC en de beslissingen na te leven.<\/li>\n<li>Tijdelijk verlies van diensten bij niet-betaling, met behoud van de betalingsplicht.<\/li>\n<li>Recht op administratief beroep bij de <span class=\"accentue\">Gemeente Pratdip<\/span> tegen de beslissingen van de EUCC.<\/li>\n<\/ul>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>Juridische draagwijdte en implicaties<\/h2>\n<p>Deze statuten formaliseerden de <span class=\"accentue\">oplegging van een verplichte entiteit<\/span> aan de eigenaars van Las Planas del Rey. Zij kenden aan de EUCC het <span class=\"accentue\">onderhoud van de infrastructuren<\/span> toe (wegen, verlichting, diensten) die normaal ten laste van de gemeente vallen. De mogelijkheid tot schuldinning via de gemeente Pratdip illustreert het <span class=\"accentue\">semi-openbaar<\/span> karakter van de entiteit, die fungeerde als een <span class=\"accentue\">schild<\/span> om de offici\u00eble overname van de urbanisatie te vermijden.
