text_line_height_tablet=\u00bb\u00bb text_line_height_phone=\u00bb1.3em\u00bb text_line_height_last_edited=\u00bbon|desktop\u00bb header_2_font_size_tablet=\u00bb\u00bb header_2_font_size_phone=\u00bb\u00bb header_2_font_size_last_edited=\u00bbon|phone\u00bb header_3_font_size_tablet=\u00bb\u00bb header_3_font_size_phone=\u00bb23px\u00bb header_3_font_size_last_edited=\u00bbon|desktop\u00bb global_colors_info=\u00bb{}\u00bb sticky_enabled=\u00bb0&#8243;]<\/p>\n<p>El <span class=\"accentue\">9 de agosto de 2002<\/span>, la <span class=\"accentue\">Entidad Colaboradora Urban\u00edstica (ECU)<\/span> de <span class=\"accentue\">Planes del Rei<\/span>, representada por <span class=\"accentue\">Ren\u00e9 Mimouni<\/span>, y el <span class=\"accentue\">Ayuntamiento de Pratdip<\/span>, representado por <span class=\"accentue\">Josep Fortuny<\/span>, firman un <span class=\"accentue\">convenio urban\u00edstico<\/span> con el fin de asegurar jur\u00eddicamente la propiedad y la gesti\u00f3n de las zonas comunes de <span class=\"accentue\">Planas del Rey (Planes del Rei)<\/span>.<\/p>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>1) Naturaleza del documento<\/h2>\n<ul>\n<li>Acuerdo administrativo (\u00ab <span class=\"accentue\">convenio urban\u00edstico<\/span> \u00bb) que regula el per\u00edodo <span class=\"accentue\">hasta la recepci\u00f3n<\/span> formal de la urbanizaci\u00f3n.<\/li>\n<li>Partes: <span class=\"accentue\">ECU<\/span> (Ren\u00e9 Mimouni) y <span class=\"accentue\">Ayuntamiento de Pratdip<\/span> (Alcalde Josep Fortuny).<\/li>\n<li>Objeto: precisar los efectos de la <span class=\"accentue\">inscripci\u00f3n registral<\/span> de los bienes comunes a nombre del ayuntamiento y organizar la gesti\u00f3n transitoria.<\/li>\n<\/ul>\n<h2>2) Contexto jur\u00eddico recordado<\/h2>\n<ul>\n<li>Urbanizaci\u00f3n iniciada en los a\u00f1os 60 por <span class=\"accentue\">Francis Lebasque<\/span>, qued\u00f3 <span class=\"accentue\">inacabada<\/span>.<\/li>\n<li><span class=\"accentue\">1968<\/span>: suspensi\u00f3n de pagos del promotor; los bienes comunes permanecen en el registro a su nombre.<\/li>\n<li><span class=\"accentue\">1993<\/span>: sentencia de <span class=\"accentue\">Falset<\/span> obligando a la cesi\u00f3n gratuita de los bienes comunes al ayuntamiento.<\/li>\n<li><span class=\"accentue\">2001<\/span>: procedimiento de <span class=\"accentue\">ejecuci\u00f3n<\/span> (art. 708 LEC); <span class=\"accentue\">inscripci\u00f3n judicial<\/span> de las zonas comunes a nombre del ayuntamiento.<\/li>\n<\/ul>\n<h2>3) Contenido esencial del convenio (\u00ab Pactos \u00bb)<\/h2>\n<ul>\n<li><span class=\"accentue\">Propiedad \u2260 Recepci\u00f3n<\/span>: la inscripci\u00f3n registral a nombre del ayuntamiento <em>no equivale<\/em> a la <span class=\"accentue\">recepci\u00f3n administrativa<\/span> de las obras.<\/li>\n<li><span class=\"accentue\">Autorizaci\u00f3n de ocupaci\u00f3n<\/span>: el ayuntamiento autoriza a la ECU a ocupar y gestionar la <span class=\"accentue\">finca registral 1169<\/span> (Registro de la Propiedad de <span class=\"accentue\">Falset<\/span>) para conservaci\u00f3n, mantenimiento, utilizaci\u00f3n de los servicios comunes y <span class=\"accentue\">finalizaci\u00f3n<\/span> de las obras.<\/li>\n<li><span class=\"accentue\">Compromiso de la ECU<\/span>: la ECU se compromete a garantizar el <span class=\"accentue\">mantenimiento<\/span>, la <span class=\"accentue\">conservaci\u00f3n<\/span> y la <span class=\"accentue\">finalizaci\u00f3n<\/span> de las obras de urbanizaci\u00f3n.<\/li>\n<\/ul>\n<h2>4) Alcance jur\u00eddico<\/h2>\n<ul>\n<li><span class=\"accentue\">Seguridad<\/span>: evitar que terceros privados reclamen los terrenos comunes ya utilizados por todos.<\/li>\n<li><span class=\"accentue\">Disociaci\u00f3n<\/span> propiedad\/recepci\u00f3n: el ayuntamiento es propietario pero la <span class=\"accentue\">recepci\u00f3n<\/span> queda aplazada.<\/li>\n<li><span class=\"accentue\">Externalizaci\u00f3n de los costes<\/span>: <em>durante la fase transitoria<\/em>, la gesti\u00f3n y los gastos permanecen a cargo de la ECU (es decir, de los propietarios).<\/li>\n<\/ul>\n<h2>5) Puntos discutibles \/ zonas de riesgo<\/h2>\n<ul>\n<li>Ausencia de <span class=\"accentue\">calendario<\/span> de recepci\u00f3n: riesgo de prolongaci\u00f3n indefinida de la fase transitoria.<\/li>\n<li><span class=\"accentue\">Carga financiera<\/span> de los propietarios sobre bienes ya <span class=\"accentue\">municipales<\/span>.<\/li>\n<li>Ambig\u00fcedad sobre la <span class=\"accentue\">definici\u00f3n precisa<\/span> de las obras pendientes y sus <span class=\"accentue\">criterios de finalizaci\u00f3n<\/span>.<\/li>\n<\/ul>\n<h2>6) Conclusi\u00f3n<\/h2>\n<p>El convenio del <span class=\"accentue\">9 de agosto de 2002<\/span> consolida una situaci\u00f3n <span class=\"accentue\">transitoria<\/span>: los bienes comunes pertenecen al ayuntamiento, pero la <span class=\"accentue\">gesti\u00f3n<\/span> y la <span class=\"accentue\">finalizaci\u00f3n<\/span> de las obras siguen en manos de la ECU <span class=\"accentue\">hasta la recepci\u00f3n<\/span>.
