Lebasque y plantea la <span class=\"accentue\">ocupaci\u00f3n<\/span>.<\/li>\n<li><span class=\"accentue\">19\/05\/1987<\/span>: <span class=\"accentue\">presente informe<\/span> de la Direcci\u00f3 General d\u2019Urbanisme.<\/li>\n<\/ul>\n<h2>3) Posici\u00f3n de la Generalitat (19\/05\/1987)<\/h2>\n<ul>\n<li>El <span class=\"accentue\">acta de ocupaci\u00f3n<\/span> puede <span class=\"accentue\">justificar<\/span> la cesi\u00f3n, pero <span class=\"accentue\">no es suficiente<\/span> por s\u00ed sola.<\/li>\n<li>Se <span class=\"accentue\">recomienda<\/span> obtener un <span class=\"accentue\">certificado del Registro de la Propiedad<\/span> que acredite la <span class=\"accentue\">imposibilidad de inscribir<\/span> una cesi\u00f3n formal.<\/li>\n<li>Es necesario <span class=\"accentue\">intentar la inscripci\u00f3n<\/span> de un <span class=\"accentue\">t\u00edtulo de adquisici\u00f3n<\/span> en el registro, incluso mediante un <span class=\"accentue\">procedimiento especial<\/span>.<\/li>\n<li>El promotor debe haber sido <span class=\"accentue\">notificado oficialmente<\/span> (<span class=\"accentue\">edicto<\/span>) con <span class=\"accentue\">advertencia de ejecuci\u00f3n subsidiaria<\/span> en caso de ausencia.<\/li>\n<li>En caso de <span class=\"accentue\">incomparecencia<\/span>, debe <span class=\"accentue\">intervenir el Ministerio Fiscal<\/span> para representar al promotor ausente, <span class=\"accentue\">al igual que en una expropiaci\u00f3n<\/span> forzosa.<\/li>\n<\/ul>\n<h2>4) Alcance y an\u00e1lisis<\/h2>\n<ul>\n<li>La Generalitat <span class=\"accentue\">define una v\u00eda legal<\/span> para recuperar los terrenos p\u00fablicos <span class=\"accentue\">sin la colaboraci\u00f3n del promotor<\/span>.<\/li>\n<li>La regularizaci\u00f3n pasa por una <span class=\"accentue\">ejecuci\u00f3n subsidiaria<\/span>: acta de ocupaci\u00f3n, <span class=\"accentue\">publicaci\u00f3n en el BOP<\/span> e <span class=\"accentue\">intervenci\u00f3n del Ministerio Fiscal<\/span>.<\/li>\n<li>No se aprecia <span class=\"accentue\">imposibilidad jur\u00eddica<\/span>; el bloqueo es administrativo y no legal.<\/li>\n<\/ul>\n<h2>5) A tener en cuenta<\/h2>\n<ul>\n<li>El <span class=\"accentue\">acta de ocupaci\u00f3n<\/span> es <span class=\"accentue\">admisible<\/span> para formalizar la cesi\u00f3n, bajo <span class=\"accentue\">ciertas condiciones<\/span>.<\/li>\n<li>Indispensable: <span class=\"accentue\">certificado del Registro<\/span>, intento de <span class=\"accentue\">inscripci\u00f3n<\/span>, <span class=\"accentue\">edictos<\/span> con advertencia de ejecuci\u00f3n, <span class=\"accentue\">intervenci\u00f3n del Ministerio Fiscal<\/span>.<\/li>\n<li>El Ayuntamiento dispon\u00eda <span class=\"accentue\">de todas las herramientas<\/span> para integrar los bienes p\u00fablicos de <span class=\"accentue\">Planes del Rei<\/span> al dominio municipal.<\/li>\n<\/ul>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h3 class=\"underline\">Documento<\/h3>\n<p style=\"padding-top: 30px;\"><a href=\"https:\/\/www.latribunedeplanas.com\/wp-content\/uploads\/2022\/08\/1987-05-19-courrier-direction-urbanisme-mairie-accord-cession.pdf\" class=\"pdfemb-viewer\" style=\"\" data-width=\"max\" data-height=\"max\" data-mobile-width=\"0\"  data-scrollbar=\"none\" data-download=\"on\" data-tracking=\"on\" data-newwindow=\"on\" data-pagetextbox=\"off\" data-scrolltotop=\"off\" data-startzoom=\"100\" data-startfpzoom=\"100\" data-toolbar=\"top\" data-toolbar-fixed=\"off\">1987-05-19-courrier-direction-urbanisme-mairie-accord-cession<br\/><\/a><\/p>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][\/et_pb_section]<\/p>\n","protected":false},"excerpt":{"rendered":"<p>El Servei d\u2019Assessoria T\u00e8cnico-Jur\u00eddica de la Direcci\u00f3 General d\u2019Urbanisme (Generalitat de Catalunya) responde al Ayuntamiento de Pratdip sobre la posibilidad de sustituir la escritura notarial de cesi\u00f3n por un acta de ocupaci\u00f3n, teniendo en cuenta la ausencia del promotor Francisco Lebasque. 1) Naturaleza del documento Informe t\u00e9cnico-jur\u00eddico de la Direcci\u00f3 General d\u2019Urbanisme (Generalitat).
