In 2008, the project intended to complete the infrastructure of Planes del Rei and allow the municipality to formally take it over reaches a new stage.<\/p>\n

The Municipal Council initially approves the technical project. A new agreement also provides a guarantee long awaited by the property owners: the works cannot be awarded for more than \u20ac7 million.<\/p>\n

The property owners approve the agreement in August. However, because its final text had not been sent to them before the General Meeting, around forty owners challenge the validity of the vote. By the end of the year, the agreement remains unsigned.<\/p>\n

This situation directly follows the attempt made in 2007, when the property owners rejected an earlier version of the agreement<\/a> because it did not provide sufficient guarantees concerning the final cost of the works.<\/p>\n

The project is also the result of a situation inherited from the development left unfinished by Francisco Lebasque. Since a Falset Court order deemed his declaration of intent to have been made in 2001<\/a>, allowing the transfer of the common areas to continue, the developer has no longer been directly involved. The matter now mainly concerns the works still requiring funding and the respective responsibilities of the Municipal Council and the EUCC.<\/p>\n

The project is submitted and receives initial approval<\/h2>\n

On 2 April 2008<\/span>, the Governing Council officially authorises the submission of the detailed project to the Municipal Council. It is delivered the following day.<\/p>\n

On 28 May 2008<\/span>, Pratdip Town Council\u2019s executive committee, the Junta de Govern Local, grants initial approval to the Planes del Rei urban development project. Property owners are notified in a letter sent on 19 June and given one month to submit comments or objections.<\/p>\n

This approval represents an important step, but it is not yet final. The agreement governing the funding, award and supervision of the works must also be approved and signed.<\/p>\n

A guarantee limits the contract to \u20ac7 million<\/h2>\n

On 4 July 2008<\/span>, representatives of the Municipal Council and the EUCC, together with their lawyers, meet in Pratdip to examine the agreement and prepare its presentation at the General Meeting in August.<\/p>\n

The new version retains the main provisions of the text presented in 2007 but adds an important guarantee: the works must be awarded under a fixed-price \u201cturnkey\u201d contract<\/span> for less than \u20ac7 million.<\/p>\n

If no company accepts these conditions, the procedure must be suspended and a new General Meeting must decide what action to take. The agreement also provides for a public tender, the maintenance of unit prices throughout the works and the creation of a committee responsible for supervising their execution.<\/p>\n

The final text arrives the day before the meeting<\/h2>\n

The final version of the agreement is not sent to the Governing Council until 9 August 2008 at 6:31 p.m.<\/span>, only a few hours before the General Meeting.<\/p>\n

The document cannot therefore be translated, photocopied and sent to the property owners before the vote. The latest amendments are only made available at the EUCC offices.<\/p>\n

This late submission becomes the main reason for the challenge. Some property owners consider that they did not have the information required to make a fully informed decision.<\/p>\n

10 August 2008 \u2013 The property owners approve the agreement<\/h2>\n

The agreement is put to a vote at the General Meeting held on 10 August 2008<\/span>. According to the minutes, the result expressed in ownership shares is as follows:<\/p>\n
