The complaint denounces <span class=\"accentue\">urban planning irregularities<\/span>, acts of <span class=\"accentue\">prevarication<\/span>, and <span class=\"accentue\">disobedience<\/span> related to the <span class=\"accentue\">reparcelaci\u00f3n<\/span> project of the <span class=\"accentue\">PAU 4 \u2013 Planas\/Planes del Rei<\/span>.<\/p>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>1) Persons concerned and context<\/h2>\n<ul>\n<li><span class=\"accentue\">Persons concerned<\/span>: <span class=\"accentue\">Joan Maria Rovira Vernet<\/span> (mayor) and <span class=\"accentue\">Izaskun Larroya Robert<\/span> (secretary-interventor), as well as any other natural or legal person who may be held responsible.<\/li>\n<li><span class=\"accentue\">Context<\/span>: since <span class=\"accentue\">2012<\/span>, the municipality has attempted to relaunch a <span class=\"accentue\">reparcelaci\u00f3n project<\/span> for the <span class=\"accentue\">PAU 4<\/span>, systematically challenged and rejected by the <span class=\"accentue\">Property Registry of Falset<\/span>. Last publication: <span class=\"accentue\">14 December 2021<\/span> in the <span class=\"accentue\">BOP of Tarragona<\/span> (\u201cModificaci\u00f3n del 2\u00ba Texto Refundido del Proyecto de Reparcelaci\u00f3n Econ\u00f3mica\u201d).<\/li>\n<\/ul>\n<h2>2) Legal grounds invoked<\/h2>\n<ul>\n<li><span class=\"accentue\">Art. 320.1 CP<\/span> \u2013 Crime against <span class=\"accentue\">land use planning and urbanism<\/span> (approvals or licenses contrary to regulations).<\/li>\n<li><span class=\"accentue\">Art. 404 CP<\/span> \u2013 <span class=\"accentue\">Administrative prevarication<\/span> (arbitrary and unjust decision taken knowingly).<\/li>\n<li><span class=\"accentue\">Art. 410.1 CP<\/span> \u2013 <span class=\"accentue\">Disobedience and denial of assistance<\/span> (refusal to execute <span class=\"accentue\">judicial rulings<\/span> or administrative orders).<\/li>\n<\/ul>\n<h2>3) Facts and irregularities denounced<\/h2>\n<ul>\n<li><span class=\"accentue\">Repeated non-enforcement<\/span> of rulings and decisions favorable to the owners and the association.<\/li>\n<li><span class=\"accentue\">Irregular publication<\/span> in the <span class=\"accentue\">BOP (14\/12\/2021)<\/span> of the <span class=\"accentue\">2\u00ba Texto Refundido<\/span> of the reparcelaci\u00f3n.<\/li>\n<li><span class=\"accentue\">Lack of individual notifications<\/span> to owners within legal deadlines (letters only sent on <span class=\"accentue\">12 January 2022<\/span>).<\/li>\n<li><span class=\"accentue\">False mention<\/span> of an <span class=\"accentue\">EUCC active<\/span>, although its <span class=\"accentue\">dissolution<\/span> was confirmed by the <span class=\"accentue\">TSJC on 21\/07\/2016<\/span>.<\/li>\n<li><span class=\"accentue\">Cessions and receptions<\/span>: green areas, roads, and facilities (pool, public spaces) already <span class=\"accentue\">materialized and received<\/span>, as confirmed by the <span class=\"accentue\">municipal report of 31\/03\/2021<\/span> (urbanization \u201c<span class=\"accentue\">fully consolidated<\/span>\u201d, maintenance only).<\/li>\n<li><span class=\"accentue\">Illegal distribution of costs<\/span>: total cost <span class=\"accentue\">\u20ac7,212,552.78<\/span>. According to <span class=\"accentue\">Art. 139 TRLUC<\/span> (cooperation): <span class=\"accentue\">44.9%<\/span> (\u2248 \u20ac3.2M) at the municipality\u2019s expense, <span class=\"accentue\">55.1%<\/span> (\u2248 \u20ac3.97M) borne by the owners.
