The appeal denounces <span class=\"accentue\">procedural defects<\/span>, <span class=\"accentue\">inaccuracies<\/span> regarding the legal status of the urbanisation, and an <span class=\"accentue\">irregular distribution of costs<\/span> to the detriment of the property owners.<\/p>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>1) Notification and access to documents<\/h2>\n<ul>\n<li><span class=\"accentue\">BOPT 14\/12\/2021<\/span>: reference made to a <span class=\"accentue\">2017 text<\/span> while a <span class=\"accentue\">new text (September 2021)<\/span> already existed.<\/li>\n<li><span class=\"accentue\">No individual notifications<\/span> were sent to the affected owners, violating procedural guarantees.<\/li>\n<\/ul>\n<h2>2) False statements in the official document<\/h2>\n<ul>\n<li>The text claims the existence of an <span class=\"accentue\">EUCC (Entitat Urban\u00edstica Col\u00b7laboradora de Conservaci\u00f3n)<\/span> still responsible for conservation and financing.<\/li>\n<li><span class=\"accentue\">However, the EUCC was dissolved<\/span> by a <span class=\"accentue\">TSJC judgment on 21\/07\/2016<\/span> (later confirmed), and the municipality was ordered to <span class=\"accentue\">execute<\/span> the dissolution.<\/li>\n<\/ul>\n<h2>3) Transfers and receptions already carried out<\/h2>\n<ul>\n<li>The project claims that the <span class=\"accentue\">transfer of green areas and streets<\/span> has not yet been materialised.<\/li>\n<li>In fact, these transfers were <span class=\"accentue\">completed as early as 1993<\/span> (<span class=\"accentue\">Falset ruling<\/span>) and subsequently confirmed, including by the <span class=\"accentue\">Diputaci\u00f3n de Tarragona<\/span>.<\/li>\n<li>A <span class=\"accentue\">technical report from 2021<\/span> confirms that the area is <span class=\"accentue\">fully consolidated<\/span>: <span class=\"accentue\">no new works<\/span> are foreseen, only <span class=\"accentue\">regular maintenance<\/span>.<\/li>\n<\/ul>\n<h2>4) Cost allocation and financial obligations<\/h2>\n<ul>\n<li>The project assigns <span class=\"accentue\">costs<\/span> to the <span class=\"accentue\">owners<\/span> that correspond to <span class=\"accentue\">public land<\/span> (approx. <span class=\"accentue\">44.9%<\/span> of the surface), which are <span class=\"accentue\">legally<\/span> the responsibility of the municipality.<\/li>\n<li><span class=\"accentue\">Total estimated cost<\/span>: <span class=\"accentue\">\u20ac7.2 million<\/span>. Owners\u2019 share: <span class=\"accentue\">\u2248 \u20ac3.97 million<\/span>. The remainder should be covered by the municipality according to surface share.<\/li>\n<li>This <span class=\"accentue\">allocation rule<\/span> is omitted or distorted in the contested municipal text.<\/li>\n<\/ul>\n<h2>5) Owners\u2019 rights and ignored alternatives<\/h2>\n<ul>\n<li>The <span class=\"accentue\">initiative<\/span> for a reparcelation project must come from owners representing more than <span class=\"accentue\">50%<\/span> of the surface (<span class=\"accentue\">art. 140 TRLUC<\/span>): condition <span class=\"accentue\">not met<\/span>.<\/li>\n<li>The option to create an <span class=\"accentue\">AAC (Asociaci\u00f3n Administrativa de Cooperaci\u00f3n)<\/span>, a legal alternative, is <span class=\"accentue\">ignored<\/span> by the municipality.<\/li>\n<\/ul>\n<h2>6) Conclusion and requests<\/h2>\n<ul>\n<li>The modified project <span class=\"accentue\">must not be approved<\/span> nor <span class=\"accentue\">registered<\/span> at the <span class=\"accentue\">Property Registry of Falset<\/span>, for the following reasons:<\/li>\n<li><span class=\"accentue\">Lack of notifications<\/span> and <span class=\"accentue\">publication defects<\/span>.<\/li>\n<li><span class=\"accentue\">Errors in dates and versions<\/span> of the reference documents.<\/li>\n<li><span class=\"accentue\">EUCC declared active<\/span> while it is <span class=\"accentue\">judicially dissolved<\/span>.<\/li>\n<li><span class=\"accentue\">Transfers already carried out<\/span> and <span class=\"accentue\">urbanisation consolidated<\/span>.<\/li>\n<li><span class=\"accentue\">Improper cost allocation<\/span> against the owners.<\/li>\n<li><span class=\"accentue\">Owners\u2019 rights ignored<\/span> and <span class=\"accentue\">legal alternatives<\/span> not considered.<\/li>\n<\/ul>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h3 class=\"underline\">Document<\/h3>\n<p style=\"padding-top: 30px;\"><a href=\"https:\/\/www.latribunedeplanas.com\/wp-content\/uploads\/2022\/02\/2021-12-29-recurso-de-alzada-alegationes-reparacelacion-2021-ayto-pratdip.pdf\" class=\"pdfemb-viewer\" style=\"\" data-width=\"max\" data-height=\"max\" data-mobile-width=\"0\"  data-scrollbar=\"none\" data-download=\"on\" data-tracking=\"on\" data-newwindow=\"on\" data-pagetextbox=\"off\" data-scrolltotop=\"off\" data-startzoom=\"100\" data-startfpzoom=\"100\" data-toolbar=\"top\" data-toolbar-fixed=\"off\">2021-12-29-recurso-de-alzada-alegationes-reparacelacion-2021-ayto-pratdip<br\/><\/a><\/p>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][\/et_pb_section]<\/p>\n","protected":false},"excerpt":{"rendered":"<p>On 29 December 2021, the Asociaci\u00f3n de Vecinos Les Planes del Rei (SOS Planas) filed a Recurso de Alzada against the Modificaci\u00f3n del 2\u00ba Texto Refundido del Proyecto de Reparcelaci\u00f3n Econ\u00f3mica del PAU 4 \u2013 Planas del Rei, approved by the Town Hall of Pratdip.
