The document is based on current legislation and several court rulings in favour of the residents.<\/p>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>1) Legal basis invoked<\/h2>\n<ul>\n<li><span class=\"accentue\">Article 66 of Law 39\/2015<\/span>: right to submit an administrative petition.<\/li>\n<li><span class=\"accentue\">Article 26 of Law 7\/1985<\/span>: municipal obligation to provide minimum public services (street lighting, drinking water, sanitation, waste collection, street cleaning, roads, etc.).<\/li>\n<\/ul>\n<h2>2) Situation of the urbanisation<\/h2>\n<ul>\n<li>The residents of Planas pay <span class=\"accentue\">IBI<\/span> and the <span class=\"accentue\">capital gains tax<\/span> on property transactions.<\/li>\n<li>The urbanisation is classified as <span class=\"accentue\">urban land<\/span> and meets the conditions of a <span class=\"accentue\">solar<\/span>: road network, water, electricity, sanitation (Art. 29 DL 1\/2010).<\/li>\n<\/ul>\n<h2>3) Case law recalled<\/h2>\n<ul>\n<li><span class=\"accentue\">TSJC \u2013 25 January 2008<\/span> (Ruling n\u00b075\/2008): condemns the Town Hall, confirms that drinking water and waste collection are municipal responsibilities, not those of the <span class=\"accentue\">Entitat Urban\u00edstica Col\u00b7laboradora de Conservaci\u00f3 (EUCC)<\/span>.<\/li>\n<li><span class=\"accentue\">Court of Falset \u2013 23 November 1993<\/span>: obliges the developer to transfer public infrastructures free of charge (roads, green areas, lighting, sanitation, water well).<\/li>\n<\/ul>\n<h2>4) Request submitted to the Town Hall<\/h2>\n<ul>\n<li>Confirm whether Planas del Rei has the status of <span class=\"accentue\">solar<\/span>.<\/li>\n<li>Explain why taxes (IBI and capital gains) are levied if the Town Hall has not officially taken over the urbanisation.<\/li>\n<li>Justify the non-enforcement of the <span class=\"accentue\">1993<\/span> court ruling, which became final due to the absence of appeal.<\/li>\n<\/ul>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h3 class=\"underline\">Document<\/h3>\n<p style=\"padding-top: 30px;\"><a href=\"https:\/\/www.latribunedeplanas.com\/wp-content\/uploads\/2025\/08\/2021-09-20-instancia-ayto-pratdip-suelo-urbano.pdf\" class=\"pdfemb-viewer\" style=\"\" data-width=\"max\" data-height=\"max\" data-mobile-width=\"0\"  data-scrollbar=\"none\" data-download=\"on\" data-tracking=\"on\" data-newwindow=\"on\" data-pagetextbox=\"off\" data-scrolltotop=\"off\" data-startzoom=\"100\" data-startfpzoom=\"100\" data-toolbar=\"top\" data-toolbar-fixed=\"off\">2021-09-20-instancia-ayto-pratdip-suelo-urbano<br\/><\/a><\/p>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][\/et_pb_section]<\/p>\n","protected":false},"excerpt":{"rendered":"<p>On 20 September 2021, the Asociaci\u00f3n de Vecinos de Les Planes del Rei submitted to the Town Hall of Pratdip an official petition in order to remind the municipality of its legal obligations and to request explanations regarding the situation of the urbanisation.
