The Court confirmed that the dissolution is <span class=\"accentue\">self-executing<\/span> and requires no additional municipal act, and that the former <span class=\"accentue\">Governing Council<\/span> becomes the <span class=\"accentue\">liquidating body<\/span> in accordance with <span class=\"accentue\">Article 195.3 of Decree 305\/2006<\/span>.<\/p>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>1) Context and procedure<\/h2>\n<ul>\n<li><span class=\"accentue\">Appeal roll of order<\/span>: <span class=\"accentue\">No. 251\/2018<\/span> (urban planning).<\/li>\n<li><span class=\"accentue\">Enforcement of judgment<\/span>: <span class=\"accentue\">No. 14\/2017<\/span> (arising from the initial appeal).<\/li>\n<li><span class=\"accentue\">Original appeal<\/span>: <span class=\"accentue\">contentious-administrative appeal No. 582\/2010<\/span> against the <span class=\"accentue\">Pratdip Town Hall<\/span> and the <span class=\"accentue\">EUCC<\/span>.<\/li>\n<li><span class=\"accentue\">Substantive judgment<\/span>: <span class=\"accentue\">TSJC, 21\/06\/2016<\/span> \u2013 <span class=\"accentue\">dissolution<\/span> of the EUCC Les Planes del Rei (final).<\/li>\n<li><span class=\"accentue\">Enforcement order<\/span>: <span class=\"accentue\">Tarragona Administrative Court No. 1, 12\/12\/2017<\/span> \u2013 recorded the dissolution and appointed the liquidating body.<\/li>\n<li><span class=\"accentue\">Parties<\/span>: <span class=\"accentue\">Appellant<\/span>: Pratdip Town Hall. <span class=\"accentue\">Respondents<\/span>: several property owners in Planas del Rey and the <span class=\"accentue\">Asociaci\u00f3n de Vecinos \u201cLes Planes del Rei\u201d<\/span>.<\/li>\n<\/ul>\n<h2>2) Claims of the Town Hall (appellant)<\/h2>\n<ul>\n<li><span class=\"accentue\">Revocation<\/span> of the order of 12\/12\/2017 (enforcement No. 14\/2017).<\/li>\n<li><span class=\"accentue\">Inadmissibility<\/span> (or alternatively, <span class=\"accentue\">dismissal<\/span>) of the enforcement request.<\/li>\n<li><span class=\"accentue\">Interpretation of Art. 195<\/span> of <span class=\"accentue\">Decree 305\/2006<\/span>: the Town Hall argued that the dissolution required a <span class=\"accentue\">formal municipal resolution<\/span> under paragraphs 1 and 2.<\/li>\n<\/ul>\n<h2>3) Legal assessment by the TSJC<\/h2>\n<ul>\n<li><span class=\"accentue\">Enforceability<\/span>: the judgment of <span class=\"accentue\">21\/06\/2016<\/span> is <span class=\"accentue\">final<\/span> and must be executed <span class=\"accentue\">as stated<\/span>. Public and private entities must <span class=\"accentue\">cooperate<\/span> (Art. <span class=\"accentue\">103 LJCA<\/span>).<\/li>\n<li><span class=\"accentue\">No prior act<\/span>: enforcement <span class=\"accentue\">does not require a municipal resolution<\/span> declaring dissolution; the judgment is a <span class=\"accentue\">complete and sufficient enforceable title<\/span>.<\/li>\n<li><span class=\"accentue\">2017 order validated<\/span>: appointment of the <span class=\"accentue\">liquidating body<\/span> (Governing Council) under <span class=\"accentue\">Art. 195.3<\/span> is correct; there is no <span class=\"accentue\">inconsistency<\/span> or <span class=\"accentue\">denial of defense<\/span>.<\/li>\n<li><span class=\"accentue\">Conclusion<\/span>: the Town Hall\u2019s arguments are unfounded; the appeal is <span class=\"accentue\">fully dismissed<\/span>.<\/li>\n<\/ul>\n<h2>4) Ruling and immediate consequences<\/h2>\n<ul>\n<li><span class=\"accentue\">Rejection<\/span> of the Pratdip Town Hall\u2019s appeal against the enforcement order (Tarragona Administrative Court No. 1, 12\/12\/2017).<\/li>\n<li><span class=\"accentue\">Order to pay costs<\/span>: charged to the Town Hall, <span class=\"accentue\">capped at \u20ac2,000<\/span> (including VAT), in favor of the respondent party.<\/li>\n<li><span class=\"accentue\">Notification<\/span>: the judgment was notified on <span class=\"accentue\">10\/05\/2021<\/span>; it allows for a <span class=\"accentue\">cassation appeal<\/span> (deadline <span class=\"accentue\">30 working days<\/span>), without prejudice to enforcement already ordered.<\/li>\n<\/ul>\n<h2>5) Scope and practical effects<\/h2>\n<ul>\n<li>The <span class=\"accentue\">EUCC Les Planes del Rei<\/span> has been <span class=\"accentue\">legally dissolved<\/span> since 2016; its effectiveness cannot depend on a new <span class=\"accentue\">municipal act<\/span>.<\/li>\n<li>The <span class=\"accentue\">liquidating body<\/span> (former Governing Council) must proceed with the <span class=\"accentue\">full liquidation<\/span> (assets, rights, obligations) under <span class=\"accentue\">Art. 195.3<\/span>.<\/li>\n<li>The <span class=\"accentue\">Pratdip Town Hall<\/span> must <span class=\"accentue\">cooperate<\/span> fully with enforcement and cannot <span class=\"accentue\">delay<\/span> or <span class=\"accentue\">block<\/span> the process through dilatory tactics.<\/li>\n<li>Any attempt to <span class=\"accentue\">maintain<\/span> the EUCC or <span class=\"accentue\">extend its effects<\/span> is <span class=\"accentue\">illegal<\/span> in light of this decision.<\/li>\n<\/ul>\n<h2>6) Key takeaways<\/h2>\n<ul>\n<li><span class=\"accentue\">Self-executing dissolution<\/span>: the 2016 judgment is sufficient by itself.<\/li>\n<li><span class=\"accentue\">No municipal act required<\/span> to \u201cconfirm\u201d the dissolution.<\/li>\n<li><span class=\"accentue\">Liquidating body<\/span>: Governing Council \u2192 full liquidation (Art. 195.3).<\/li>\n<li><span class=\"accentue\">Costs<\/span>: Town Hall condemned (maximum <span class=\"accentue\">\u20ac2,000 incl.
