The Town Hall claimed it had no competence in the urbanisation, referred to the <span class=\"accentue\">Conservation Entity<\/span> (EUCC) which it considered not definitively dissolved, and invoked <span class=\"accentue\">Art. 120 of DL 1\/2010<\/span> (urbanisation costs to be borne by the owners) and <span class=\"accentue\">Art. 169 of Decree 305\/2006<\/span> (non-reception). Entry reference: <span class=\"accentue\">2019-E-RC-941<\/span>. <\/p>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>1) Context and scope<\/h2>\n<ul>\n<li><span class=\"accentue\">Recipient<\/span>: Mr. Mike Allen (resident of Planes del Rei \/ Planas del Rey).<\/li>\n<li><span class=\"accentue\">Subject<\/span>: absence of lighting in the streets of the urbanisation.<\/li>\n<li><span class=\"accentue\">Reference<\/span>: registry entry <span class=\"accentue\">2019-E-RC-941<\/span>.<\/li>\n<li><span class=\"accentue\">Nature<\/span>: official letter in Catalan, electronically signed by the mayor.<\/li>\n<\/ul>\n<h2>2) Position and legal grounds invoked by the Town Hall<\/h2>\n<ul>\n<li><span class=\"accentue\">Claimed incompetence<\/span>: the <span class=\"accentue\">Town Hall<\/span> stated it had no \u201cpotestat d\u2019actuaci\u00f3\u201d within the urbanisation.<\/li>\n<li><span class=\"accentue\">EUCC \u201cnot dissolved\u201d<\/span>: conservation would still fall under the <span class=\"accentue\">Conservation Entity<\/span>, which, according to the Town Hall, was not \u201cdefinitively resolved\u201d.<\/li>\n<li><span class=\"accentue\">Legal basis cited<\/span>:\n<ul>\n<li><span class=\"accentue\">Art. 120 \u2013 DL 1\/2010<\/span>: <span class=\"accentue\">lighting<\/span> is considered an urbanisation cost borne by property owners.<\/li>\n<li><span class=\"accentue\">Art. 169 \u2013 Decree 305\/2006<\/span>: in the absence of <span class=\"accentue\">reception<\/span>, maintenance remains the responsibility of the owners.<\/li>\n<\/ul>\n<\/li>\n<li><span class=\"accentue\">Consequence<\/span>: the request should be addressed to the <span class=\"accentue\">urbanistic entity responsible<\/span> (EUCC) and not the Town Hall.<\/li>\n<\/ul>\n<h2>3) Observations and contentious points (outside the letter\u2019s content)<\/h2>\n<ul>\n<li><span class=\"accentue\">On the EUCC<\/span>: the thesis of an \u201cactive\u201d EUCC was later challenged in light of court rulings confirming its dissolution.<\/li>\n<li><span class=\"accentue\">On street lighting<\/span>: lighting is generally recognised as an <span class=\"accentue\">essential local public service<\/span>; treating it as a permanent private expense is disputable when the urbanisation has been inhabited for decades.<\/li>\n<li><span class=\"accentue\">On reception<\/span>: <span class=\"accentue\">non-reception<\/span> cannot indefinitely justify the lack of minimum services; it mainly highlights the Town Hall\u2019s inaction in concluding the procedure.<\/li>\n<\/ul>\n<h2>4) Practical consequences for residents<\/h2>\n<ul>\n<li><span class=\"accentue\">Shift of responsibility<\/span> to a so-called Conservation Entity, blocking immediate municipal intervention.<\/li>\n<li><span class=\"accentue\">Persistence of problems<\/span> (insecurity, unlit streets) and financial burden shifted onto owners.<\/li>\n<li><span class=\"accentue\">Template argument<\/span> reusable by the Town Hall to deny other services (water, roads, sanitation) in the absence of reception.<\/li>\n<\/ul>\n<h2>5) Possible courses of action<\/h2>\n<ul>\n<li><span class=\"accentue\">Recall<\/span> later court decisions confirming the EUCC\u2019s dissolution and the <span class=\"accentue\">municipal responsibility<\/span> for essential services.<\/li>\n<li><span class=\"accentue\">Demand<\/span> a formal timetable for <span class=\"accentue\">reception<\/span> of works and a transitional <span class=\"accentue\">lighting<\/span> plan (immediate safety).<\/li>\n<li><span class=\"accentue\">Document<\/span> risks (traffic safety, thefts, falls) and <span class=\"accentue\">formally require<\/span> the Town Hall to guarantee a minimum service.<\/li>\n<\/ul>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h3 class=\"underline\">Document<\/h3>\n<p style=\"padding-top: 30px;\"><a href=\"https:\/\/www.latribunedeplanas.com\/wp-content\/uploads\/2025\/08\/2019-07-12-courrier-mike-mairie.pdf\" class=\"pdfemb-viewer\" style=\"\" data-width=\"max\" data-height=\"max\" data-mobile-width=\"0\"  data-scrollbar=\"none\" data-download=\"on\" data-tracking=\"on\" data-newwindow=\"on\" data-pagetextbox=\"off\" data-scrolltotop=\"off\" data-startzoom=\"100\" data-startfpzoom=\"100\" data-toolbar=\"top\" data-toolbar-fixed=\"off\">2019-07-12-courrier-mike-mairie<br\/><\/a><\/p>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][\/et_pb_section]<\/p>\n","protected":false},"excerpt":{"rendered":"<p>On 12 July 2019, the Mayor of Pratdip replied to Mr. Mike Allen (Planes del Rei \/ Planas del Rey) regarding the absence of street lighting.
