header_3_font_size_phone=&#8221;23px&#8221; header_3_font_size_last_edited=&#8221;on|desktop&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<p>On <span class=\"accentue\">21 July 2016<\/span>, the <span class=\"accentue\">Secci\u00f3n Tercera<\/span> of the <span class=\"accentue\">Sala de lo Contencioso-Administrativo<\/span> of the <span class=\"accentue\">Tribunal Superior de Justicia de Catalu\u00f1a (TSJC)<\/span> ruled on the appeal filed by several <span class=\"accentue\">owners<\/span>, grouped within the <span class=\"accentue\">SOS Planas association<\/span>, against the <span class=\"accentue\">Ayuntamiento de Pratdip<\/span> and the <span class=\"accentue\">EUCC Les Planes del Rei<\/span>.<br \/>\nThe Court <span class=\"accentue\">partially revoked<\/span> the first instance judgment (26\/03\/2013, n\u00b0130\/2013) and admitted the <span class=\"accentue\">dissolution<\/span> of the EUCC, marking a <span class=\"accentue\">decisive victory<\/span> for SOS Planas.<\/p>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>1) Context<\/h2>\n<ul>\n<li><span class=\"accentue\">Procedure<\/span>: appeal n\u00b0582\/2010 filed by the owners through SOS Planas.<\/li>\n<li><span class=\"accentue\">First instance<\/span>: Juzgado Contencioso-Administrativo n\u00b01 de Tarragona, judgment of 26 March 2013 rejecting the request for dissolution.<\/li>\n<li><span class=\"accentue\">Parties on appeal<\/span>: SOS Planas (appellants) vs. Pratdip Town Council and EUCC.<\/li>\n<\/ul>\n<h2>2) Court\u2019s reasoning<\/h2>\n<ul>\n<li><span class=\"accentue\">Legal framework<\/span>: Legislative Decree 1\/1990 (Catalonia Urban Planning Law).<\/li>\n<li><span class=\"accentue\">Maximum duration<\/span>: obligation of the owners to maintain the urbanisation limited to 5 years after 1990.<\/li>\n<li><span class=\"accentue\">Finding<\/span>: this period had long expired;
