It therefore requests its <span class=\"accentue\">dismissal<\/span>.<\/p>\n<h3>b) Historical background<\/h3>\n<p>The memorandum traces the history since <span class=\"accentue\">1965<\/span>:<\/p>\n<ul>\n<li><span class=\"accentue\">1965<\/span>: approval of the partial plan, with owners responsible for services until transfer.<\/li>\n<li><span class=\"accentue\">1968\u20131987<\/span>: repeated failed attempts to transfer assets; disappearance of developer Lebasqu\u00e9.<\/li>\n<li><span class=\"accentue\">1987<\/span>: creation of the <span class=\"accentue\">EUCC Les Planes del Rei<\/span>.<\/li>\n<li><span class=\"accentue\">1993<\/span>: court ruling obliging Lebasqu\u00e9 to transfer certain plots.<\/li>\n<li><span class=\"accentue\">2001<\/span>: judicial enforcement, but only partial (\u224815% of planned transfers).<\/li>\n<li><span class=\"accentue\">2005\u20132008<\/span>: EUCC assemblies (with participation of the current appellants) approving urbanization projects and agreements with the municipality.<\/li>\n<li><span class=\"accentue\">2009\u20132010<\/span>: ratification of agreements; recognition of the need for <span class=\"accentue\">reparcelaci\u00f3n<\/span>.<\/li>\n<li><span class=\"accentue\">2012<\/span>: approval of the reparcelaci\u00f3n project, providing for equitable distribution of costs and regularization of transfers.<\/li>\n<\/ul>\n<h3>c) Impossibility of dissolving the EUCC<\/h3>\n<ul>\n<li>The <span class=\"accentue\">EUCC<\/span> has not completed the planned <span class=\"accentue\">common works<\/span>.<\/li>\n<li>A technical report (architect P\u00e9rez Pastor) confirms that the infrastructures are <span class=\"accentue\">obsolete<\/span> and incomplete.<\/li>\n<li>The <span class=\"accentue\">POUM<\/span> and current legislation still require completion of the works by the <span class=\"accentue\">owners<\/span>.<\/li>\n<li>The transfers already completed cover only about <span class=\"accentue\">15%<\/span> of obligations.<\/li>\n<\/ul>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>3) Conclusion of the memorandum<\/h2>\n<ul>\n<li><span class=\"accentue\">Inadmissibility<\/span> of the appeal for lack of substantiation.<\/li>\n<li>Failing that, <span class=\"accentue\">confirmation<\/span> of the judgment: maintenance of the EUCC, obligation for owners to complete and finance the urbanization.<\/li>\n<li>The municipality accuses the appellants of <span class=\"accentue\">bad faith<\/span>, as they had participated in assemblies approving the projects and now seek to shift the financial burden.<\/li>\n<\/ul>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h3 class=\"underline\">Document<\/h3>\n<p style=\"padding-top: 30px;\"><a href=\"https:\/\/www.latribunedeplanas.com\/wp-content\/uploads\/2017\/09\/04-07-2013-allegation.pdf\" class=\"pdfemb-viewer\" style=\"\" data-width=\"max\" data-height=\"max\" data-mobile-width=\"0\"  data-scrollbar=\"none\" data-download=\"on\" data-tracking=\"on\" data-newwindow=\"on\" data-pagetextbox=\"off\" data-scrolltotop=\"off\" data-startzoom=\"100\" data-startfpzoom=\"100\" data-toolbar=\"top\" data-toolbar-fixed=\"off\">04-07-2013-allegation<br\/><\/a><\/p>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][\/et_pb_section]<\/p>\n","protected":false},"excerpt":{"rendered":"<p>On June 4, 2013, the Ajuntament de Pratdip filed a memorandum of opposition before the Contentious-Administrative Court No. 1 of Tarragona, in the framework of appeal 582\/2010 brought by the Asociaci\u00f3n de Vecinos SOS Planas.
