header_3_font_size_phone=&#8221;23px&#8221; header_3_font_size_last_edited=&#8221;on|desktop&#8221; global_colors_info=&#8221;{}&#8221; sticky_enabled=&#8221;0&#8243;]<\/p>\n<p>On <span class=\"accentue\">26 March 2013<\/span>, the <span class=\"accentue\">Administrative Court n\u00b01 of Tarragona<\/span> ruled on the appeal lodged by the <span class=\"accentue\">Asociaci\u00f3n de Vecinos (SOS Planas)<\/span> seeking the <span class=\"accentue\">dissolution<\/span> of the <span class=\"accentue\">Entitat Urban\u00edstica Col\u00b7laboradora de Conservaci\u00f3n (EUCC) Les Planes del Rei<\/span>.<br \/>\nThe request was rejected, on the grounds that the <span class=\"accentue\">urbanisation works<\/span> had not yet been officially <span class=\"accentue\">received<\/span> by the <span class=\"accentue\">Municipality of Pratdip<\/span>.<br \/>\nAs a result, the EUCC maintains its legal existence and the municipality is not obliged to immediately assume the minimum services.<\/p>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>1) Context<\/h2>\n<ul>\n<li><span class=\"accentue\">Plaintiff<\/span>: Asociaci\u00f3n de Vecinos Les Planes del Rei (SOS Planas &#8211; homeowners\u2019 association).<\/li>\n<li><span class=\"accentue\">Purpose<\/span>: obtain the dissolution of the EUCC and the transfer of services to the municipality.<\/li>\n<li><span class=\"accentue\">Plaintiffs\u2019 argument<\/span>: infrastructures were considered to have already been delivered to the municipality.<\/li>\n<li><span class=\"accentue\">Municipality\u2019s reply<\/span>: absence of formal reception of the works, maintenance of the EUCC.<\/li>\n<\/ul>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>2) Court reasoning<\/h2>\n<ul>\n<li>The administrative silence of the municipality amounted to an implicit rejection, but the appeal was admissible.<\/li>\n<li>Review of the <span class=\"accentue\">EUCC\u2019s minutes<\/span> (2005-2008): no record of official delivery of infrastructures.<\/li>\n<li><span class=\"accentue\">23\/02\/2009<\/span>: approval of the urbanisation project by the municipality.<\/li>\n<li><span class=\"accentue\">2009-2010<\/span>: successive agreements municipality-EUCC for the execution of works and management of certain services (water, waste).<\/li>\n<li><span class=\"accentue\">09\/02\/2010<\/span>: publication in the DOGC of the POUM confirming <span class=\"accentue\">shortcomings<\/span> to be corrected.<\/li>\n<li><span class=\"accentue\">2011<\/span>: change of the system of action to \u201ccooperation\u201d to benefit from subsidies and complete re-urbanisation.<\/li>\n<li>Judge\u2019s conclusion: without official reception of the infrastructures, dissolution of the EUCC is legally impossible.<\/li>\n<\/ul>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>3) Consequences<\/h2>\n<ul>\n<li>The EUCC <span class=\"accentue\">remains in force<\/span> until the works are received by the municipality.<\/li>\n<li>Homeowners must continue to finance the EUCC and its services.<\/li>\n<li>The Municipality of Pratdip <span class=\"accentue\">delays its obligations<\/span>, using the lack of reception as a legal argument.<\/li>\n<li>The judgment represents a <span class=\"accentue\">setback for SOS Planas<\/span>, postponing dissolution until 2016 after further proceedings.<\/li>\n<\/ul>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h3 class=\"underline\">Document<\/h3>\n<p style=\"padding-top: 30px;\"><a href=\"https:\/\/www.latribunedeplanas.com\/wp-content\/uploads\/2025\/08\/2013-03-26-jugement-130-2013-sosplanas-tarragona.pdf\" class=\"pdfemb-viewer\" style=\"\" data-width=\"max\" data-height=\"max\" data-mobile-width=\"0\"  data-scrollbar=\"none\" data-download=\"on\" data-tracking=\"on\" data-newwindow=\"on\" data-pagetextbox=\"off\" data-scrolltotop=\"off\" data-startzoom=\"100\" data-startfpzoom=\"100\" data-toolbar=\"top\" data-toolbar-fixed=\"off\">2013-03-26-jugement-130-2013-sosplanas-tarragona<br\/><\/a><\/p>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][\/et_pb_section]<\/p>\n","protected":false},"excerpt":{"rendered":"<p>On 26 March 2013, the Administrative Court n\u00b01 of Tarragona ruled on the appeal lodged by the Asociaci\u00f3n de Vecinos (SOS Planas) seeking the dissolution of the Entitat Urban\u00edstica Col\u00b7laboradora de Conservaci\u00f3n (EUCC) Les Planes del Rei.
