header_3_font_size_phone=&#8221;23px&#8221; header_3_font_size_last_edited=&#8221;on|desktop&#8221; global_colors_info=&#8221;{}&#8221; sticky_enabled=&#8221;0&#8243;]<\/p>\n<p>On <span class=\"accentue\">28\/12\/2010<\/span>, the <span class=\"accentue\">Town Hall of Pratdip<\/span> and the <span class=\"accentue\">Consell Comarcal del Baix Camp<\/span> approved an <span class=\"accentue\">annex<\/span> to the initial agreement, extending the framework of the <span class=\"accentue\">exceptional and subsidiary management<\/span> of <span class=\"accentue\">drinking water<\/span> in <span class=\"accentue\">Planas del Rey (Planes del Rei)<\/span>.<br \/>\nThis annex introduces, for the first time, <span class=\"accentue\">maintenance and inspection<\/span> measures of the network, entrusted to <span class=\"accentue\">Comaigua SL<\/span>.<\/p>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>1) Context and justification<\/h2>\n<ul>\n<li><span class=\"accentue\">Ownership of the network<\/span>: the internal water installations remain the property of the <span class=\"accentue\">owners<\/span>, never transferred or received due to their obsolescence.<\/li>\n<li><span class=\"accentue\">Limited municipal competence<\/span>: the Town Hall cannot assume ordinary management until <span class=\"accentue\">reparcelaci\u00f3n<\/span> and <span class=\"accentue\">official reception<\/span> of the urbanisation works are carried out.<\/li>\n<li><span class=\"accentue\">Legal framework<\/span>: several rulings (2013, TSJC 2016) confirm the Town Hall has no ordinary competence; it acts only <span class=\"accentue\">exceptionally and subsidiarily<\/span> (art. 21.1.m of Law 7\/1985).<\/li>\n<li><span class=\"accentue\">Financial burden<\/span>: funding remains entirely with the <span class=\"accentue\">owners<\/span> of the private urbanisation.<\/li>\n<\/ul>\n<h2>2) New actions under the annex<\/h2>\n<ul>\n<li><span class=\"accentue\">Surveillance, inspection and corrective maintenance<\/span> of the network, 24\/7 and 365 days\/year.<\/li>\n<li><span class=\"accentue\">Installation<\/span> of <span class=\"accentue\">remote control<\/span> and <span class=\"accentue\">general meters<\/span> (provided by the operator, billed to subscribers).<\/li>\n<li><span class=\"accentue\">Annual cleaning<\/span> of water tanks.<\/li>\n<\/ul>\n<p class=\"accentue\" style=\"margin: 12px 0;\">These maintenance tasks are entrusted to <span class=\"accentue\">Comaigua SL<\/span>, as the specialised operator mandated by the Consell Comarcal.<\/p>\n<h2>3) Cost and financing<\/h2>\n<ul>\n<li><span class=\"accentue\">Annual amount<\/span>: <span class=\"accentue\">49,485.29 \u20ac<\/span> + VAT.<\/li>\n<li><span class=\"accentue\">Breakdown<\/span>: staff (20,367.73 \u20ac), tank cleaning (4,417 \u20ac), materials (17,875 \u20ac), general expenses (6,825.58 \u20ac).<\/li>\n<li><span class=\"accentue\">Billing<\/span>: the cost is fully passed on to the <span class=\"accentue\">users<\/span> of Planas del Rey.<\/li>\n<\/ul>\n<h2>4) Duration and termination<\/h2>\n<ul>\n<li><span class=\"accentue\">Duration<\/span>: 1 year, expressly renewable annually.<\/li>\n<li><span class=\"accentue\">Early termination<\/span>: possible unilaterally by either party with <span class=\"accentue\">3 months\u2019 notice<\/span>, or by mutual agreement.<\/li>\n<\/ul>\n<h2>5) Practical consequences<\/h2>\n<ul>\n<li><span class=\"accentue\">No reception<\/span>: the formalisation of the annex does not constitute reception of the urbanisation, not even partially.<\/li>\n<li><span class=\"accentue\">Minimum service<\/span>: the intervention only aims to guarantee access to water as a basic service, without assuming full municipal responsibility.<\/li>\n<li><span class=\"accentue\">Owners\u2019 burden<\/span>: costs and investments remain borne by residents.<\/li>\n<\/ul>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h3 class=\"underline\">Document<\/h3>\n<p style=\"padding-top: 30px;\"><a href=\"https:\/\/www.latribunedeplanas.com\/wp-content\/uploads\/2019\/08\/2010-12-28-annex-conveni-comaigua.pdf\" class=\"pdfemb-viewer\" style=\"\" data-width=\"max\" data-height=\"max\" data-mobile-width=\"0\"  data-scrollbar=\"none\" data-download=\"on\" data-tracking=\"on\" data-newwindow=\"on\" data-pagetextbox=\"off\" data-scrolltotop=\"off\" data-startzoom=\"100\" data-startfpzoom=\"100\" data-toolbar=\"top\" data-toolbar-fixed=\"off\">2010-12-28-annex-conveni-comaigua<br\/><\/a><\/p>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][\/et_pb_section]<\/p>\n","protected":false},"excerpt":{"rendered":"<p>On 28\/12\/2010, the Town Hall of Pratdip and the Consell Comarcal del Baix Camp approved an annex to the initial agreement, extending the framework of the exceptional and subsidiary management of drinking water in Planas del Rey (Planes del Rei).
