The invoices are issued in the name of the Town Hall, which remains responsible for the service, while the material execution is delegated.<\/p>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>1) Parties and date<\/h2>\n<ul>\n<li><span class=\"accentue\">Date<\/span>: 28\/12\/2010 (Reus).<\/li>\n<li><span class=\"accentue\">Parties<\/span>: Consell Comarcal (President <span class=\"accentue\">Josep Masdeu Isern<\/span>) and <span class=\"accentue\">Town Hall of Pratdip<\/span> (Mayor <span class=\"accentue\">Josep Muntan\u00e9 i Vidal<\/span>), assisted by their secretaries.<\/li>\n<li><span class=\"accentue\">Legal basis<\/span>: Legislative Decrees 2\/2003 and 4\/2003 (Catalonia), Law 7\/1985 (Local Regime Bases), Decree 179\/1995 (ROAS), Law 26\/2010 (Catalonia), Consolidated Text on Water (DL 3\/2003), etc.<\/li>\n<\/ul>\n<h2>2) Purpose of the agreement<\/h2>\n<ul>\n<li><span class=\"accentue\">Meter reading<\/span> for the subscribers of Planas del Rey (Planes del Rei).<\/li>\n<li><span class=\"accentue\">Quarterly billing and collection<\/span> (payment slips, control lists, management of unpaid bills).<\/li>\n<li><span class=\"accentue\">Sanitary control<\/span> (disinfection, analyses \u2013 compliance with <span class=\"accentue\">RD 140\/2003<\/span>).<\/li>\n<li><span class=\"accentue\">Management of the Water Canon<\/span> (preparation and submission of information to the ACA \u2013 direct payment by the managing entity).<\/li>\n<li><span class=\"accentue\">Replacement<\/span> of <span class=\"accentue\">30 meters<\/span> (renewal due to age; other replacements billed according to unit prices annexed).<\/li>\n<\/ul>\n<p class=\"accentue\" style=\"margin: 12px 0;\">Important: the text <u>does not provide for the maintenance\/renovation of the network<\/u> (pipelines, reservoirs, pumping stations). It mainly organises the administrative and basic sanitary management.<\/p>\n<h2>3) Territorial scope and applicable regulations<\/h2>\n<ul>\n<li><span class=\"accentue\">Scope<\/span>: urbanisation <span class=\"accentue\">Planas del Rey (Planes del Rei)<\/span>.<\/li>\n<li><span class=\"accentue\">Regional regulation<\/span>: application of the <span class=\"accentue\">Regional Water and Sewerage Regulation<\/span> (BOP Tarragona n\u00b0133, 10\/06\/2010); if there is a municipal regulation, its <span class=\"accentue\">effectiveness is suspended<\/span> during the delegation.<\/li>\n<\/ul>\n<h2>4) Tariffs, billing and settlement<\/h2>\n<ul>\n<li><span class=\"accentue\">Tariffs<\/span>: application of the <span class=\"accentue\">2011 municipal tariffs<\/span> (Annex 2 \u2013 annual economic study prepared by the managing entity).<\/li>\n<li><span class=\"accentue\">Costs included<\/span>: <span class=\"accentue\">electricity<\/span> and <span class=\"accentue\">maintenance of the \u201cLes Sorts\u201d well<\/span> (amounts determined annually by the Town Hall).<\/li>\n<li><span class=\"accentue\">Periodicity<\/span>: quarterly billing for elapsed periods.<\/li>\n<li><span class=\"accentue\">Settlement<\/span>: amounts collected transferred to the Town Hall <span class=\"accentue\">135 days<\/span> after invoice issuance, <span class=\"accentue\">deducting<\/span> the managing entity\u2019s invoiced costs.<\/li>\n<\/ul>\n<h2>5) Price of the management service (Secomsa Aig\u00fces)<\/h2>\n<ul>\n<li><span class=\"accentue\">Annual amount<\/span>: <span class=\"accentue\">35,518.62 \u20ac<\/span> + <span class=\"accentue\">VAT 18%<\/span> (rate at the time of signing), billed quarterly.<\/li>\n<li><span class=\"accentue\">Revision<\/span>: from January 1, 2012 and annually thereafter, based on the <span class=\"accentue\">Catalonia CPI<\/span> (floor: never lower than the previous year).<\/li>\n<\/ul>\n<h2>6) Duration, renewal and termination<\/h2>\n<ul>\n<li><span class=\"accentue\">Initial term<\/span>: from the billing of the <span class=\"accentue\">1st quarter of 2011<\/span> until the <span class=\"accentue\">4th quarter of 2011<\/span>.<\/li>\n<li><span class=\"accentue\">Renewal<\/span>: tacit for successive annual periods.<\/li>\n<li><span class=\"accentue\">Termination<\/span>: by either party with <span class=\"accentue\">3 months\u2019 notice<\/span> before each expiry date.<\/li>\n<\/ul>\n<h2>7) Data protection<\/h2>\n<ul>\n<li><span class=\"accentue\">Controller<\/span>: Town Hall of Pratdip;
