header_3_font_size_last_edited=&#8221;on|desktop&#8221; global_colors_info=&#8221;{}&#8221; sticky_enabled=&#8221;0&#8243;]<\/p>\n<p>On <span class=\"accentue\">10 September 2009<\/span>, the <span class=\"accentue\">Municipality of Pratdip<\/span> and the <span class=\"accentue\">EUCC Les Planes del Rei<\/span> signed an <span class=\"accentue\">agreement<\/span> regulating the billing and collection of <span class=\"accentue\">drinking water<\/span> and <span class=\"accentue\">household waste<\/span>.<br \/>\nOn <span class=\"accentue\">22 July 2010<\/span>, an <span class=\"accentue\">enforceable judgment<\/span> (the <span class=\"accentue\">Fenouillet<\/span> case) reaffirmed that the <span class=\"accentue\">EUCC<\/span> had <span class=\"accentue\">no legitimacy<\/span> to manage these services, which fall exclusively under the responsibility of the <span class=\"accentue\">Municipality<\/span>.<br \/>\nThis continuity highlights a <span class=\"accentue\">flagrant contradiction<\/span> between the municipality\u2019s practices and judicial decisions.<\/p>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>1) Context<\/h2>\n<ul>\n<li><span class=\"accentue\">2008<\/span>: the TSJC recalled that the municipality remains responsible for <span class=\"accentue\">minimum public services<\/span>, despite the existence of the EUCC.<\/li>\n<li><span class=\"accentue\">2009<\/span>: signature of an agreement allowing the EUCC to continue billing for water and waste.<\/li>\n<li><span class=\"accentue\">2010<\/span>: the court declared the \u201cFenouillet\u201d judgment enforceable, confirming that this delegation was <span class=\"accentue\">illegal<\/span>.<\/li>\n<\/ul>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>2) Analysis<\/h2>\n<h3>Agreement of 10 September 2009<\/h3>\n<ul>\n<li><span class=\"accentue\">Purpose<\/span>: to organize the management, billing and collection of water and waste by the EUCC.<\/li>\n<li><span class=\"accentue\">Effect<\/span>: the municipality <span class=\"accentue\">institutionalized<\/span> a delegation system contrary to the law.<\/li>\n<li><span class=\"accentue\">Consequence<\/span>: residents remained subject to EUCC charges.<\/li>\n<\/ul>\n<h3>Enforceable Judgment of 22 July 2010<\/h3>\n<ul>\n<li><span class=\"accentue\">Judicial confirmation<\/span>: the EUCC has no legal competence to manage water and waste.<\/li>\n<li><span class=\"accentue\">Immediate execution<\/span>: the municipality is directly obliged to take charge of these services.<\/li>\n<li><span class=\"accentue\">Invalidation<\/span>: the 2009 agreement thus became <span class=\"accentue\">null and void<\/span>.<\/li>\n<\/ul>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>3) Consequences<\/h2>\n<ul>\n<li>Residents are <span class=\"accentue\">entitled to refuse<\/span> to pay the EUCC for water and waste after 2010.<\/li>\n<li>The Municipality of Pratdip can no longer invoke the EUCC to evade its <span class=\"accentue\">legal obligations<\/span>.<\/li>\n<li>The contradiction between the 2009 agreement and the 2010 judgment illustrates the municipality\u2019s <span class=\"accentue\">bad faith<\/span> and its <span class=\"accentue\">refusal to assume<\/span> its responsibilities.<\/li>\n<\/ul>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h3 class=\"underline\">Document<\/h3>\n<p style=\"padding-top: 30px;\"><a href=\"https:\/\/www.latribunedeplanas.com\/wp-content\/uploads\/2008\/01\/2010-07-22-sentence-executoire-fenouillet-agua-basuras.pdf\" class=\"pdfemb-viewer\" style=\"\" data-width=\"max\" data-height=\"max\" data-mobile-width=\"0\"  data-scrollbar=\"none\" data-download=\"on\" data-tracking=\"on\" data-newwindow=\"on\" data-pagetextbox=\"off\" data-scrolltotop=\"off\" data-startzoom=\"100\" data-startfpzoom=\"100\" data-toolbar=\"top\" data-toolbar-fixed=\"off\">2010-07-22-sentence-executoire-fenouillet-agua-basuras<br\/><\/a><\/p>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][\/et_pb_section]<\/p>\n","protected":false},"excerpt":{"rendered":"<p>On 10 September 2009, the Municipality of Pratdip and the EUCC Les Planes del Rei signed an agreement regulating the billing and collection of drinking water and household waste.
