<span class=\"accentue\">homeowners<\/span> from <span class=\"accentue\">Planas del Rey (Planes del Rei)<\/span> filed an <span class=\"accentue\">administrative appeal<\/span> against the <span class=\"accentue\">Pratdip Town Council<\/span>, challenging the <span class=\"accentue\">refusal to accept<\/span> the urbanisation and seeking recognition of the municipal obligation to guarantee the <span class=\"accentue\">minimum public services<\/span>.<\/p>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>1) Context<\/h2>\n<ul>\n<li><span class=\"accentue\">Date<\/span>: 15\/11\/2009.<\/li>\n<li><span class=\"accentue\">Authors<\/span>: homeowners of the urbanisation.<\/li>\n<li><span class=\"accentue\">Purpose<\/span>: annulment of the refusal of acceptance and class=\"accentue\">Pratdip Town Council<\/span> to accept <span class=\"accentue\">Planas del Rey (Planes del Rei)<\/span>.<\/li>\n<li>Alleged grounds: <span class=\"accentue\">non-compliance<\/span> of the infrastructures and prior requirement of a <span class=\"accentue\">reparcelaci\u00f3n<\/span>.<\/li>\n<\/ul>\n<h2>3) Homeowners\u2019 arguments<\/h2>\n<ul>\n<li><span collection, sanitation).<\/li>\n<li>The <span class=\"accentue\">Law on the Bases of the Local Regime (art. 26)<\/span> already obliges the municipality to provide these services, regardless of a full re-urbanisation.<\/li>\n<li>The existence of an <span class=\"accentue\">EUCC Les Planes del Rei (Entitat Urban\u00edstica Col\u00b7laboradora de Conservacion)<\/span> does not exempt the council from its obligations towards residents.<\/li>\n<\/ul>\n<h2>4) Cited case law<\/h2>\n<ul>\n<li>Explicit reference to a <span class=\"accentue\">previous judgment<\/span> (in particular the <span scope<\/h2>\n<ul>\n<li><span class=\"accentue\">Municipal strategy<\/span>: to invoke <span class=\"accentue\">reparcelaci\u00f3n<\/span> to delay acceptance and transfer the financial burden onto the residents.<\/li>\n<li><span class=\"accentue\">Legal strength<\/span> of the appeal: based on the law (art. 26) and on <span class=\"accentue\">case law<\/span> already unfavourable to the council.<\/li>\n<li><span class=\"accentue\">Evidentiary value<\/span>: demonstrates that as early as <span class=\"accentue\">2009<\/span>, homeowners were already challenging the \u201creparcelaci\u00f3n prerequisite\u201d and recalling the <span class=\"accentue\">previous condemnations<\/span>.<\/li>\n<\/ul>\n<h2>7) Conclusion<\/h2>\n<ul>\n<li>The 2009 appeal is a key document: it <span class=\"accentue\">refutes<\/span> the argument \u201cno reparcelaci\u00f3n, no acceptance\u201d, and <span class=\"accentue\">reaffirms<\/span> the municipal responsibility to guarantee minimum services.<\/li>\n<li>It highlights the <span class=\"accentue\">persistence<\/span> of an administrative and political deadlock despite the existing <span class=\"accentue\">case
