header_3_font_size_last_edited=&#8221;on|desktop&#8221; global_colors_info=&#8221;{}&#8221; sticky_enabled=&#8221;0&#8243;]<\/p>\n<p>On <span class=\"accentue\">10 September 2009<\/span>, the <span class=\"accentue\">Municipality of Pratdip<\/span> (Mayor <span class=\"accentue\">Josep Montan\u00e9 i Vidal<\/span>) and the <span class=\"accentue\">EUCC Les Planes del Rei<\/span> (President <span class=\"accentue\">Christian Peuman<\/span>) signed a <span class=\"accentue\">convenio<\/span> regulating the management of <span class=\"accentue\">drinking water<\/span> (billing\/collection) and <span class=\"accentue\">waste<\/span> in <span class=\"accentue\">Planas del Rey (Planes del Rei)<\/span>, in reference to the <span class=\"accentue\">TSJC ruling of 25\/01\/2008<\/span>.<\/p>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>1) Context and purpose<\/h2>\n<ul>\n<li><span class=\"accentue\">Purpose<\/span>: to regulate the <span class=\"accentue\">billing and collection<\/span> of drinking water by the municipality, as well as the <span class=\"accentue\">collection and billing<\/span> of waste.<\/li>\n<li><span class=\"accentue\">Legal context<\/span>: partial implementation of the <span class=\"accentue\">25\/01\/2008 ruling<\/span> confirming that the existence of an EUCC does not exempt the municipality from providing <span class=\"accentue\">minimum services<\/span>.<\/li>\n<\/ul>\n<h2>2) Signatory parties<\/h2>\n<ul>\n<li><span class=\"accentue\">Municipality of Pratdip<\/span>: <span class=\"accentue\">Josep Montan\u00e9 i Vidal<\/span>, Mayor-President.<\/li>\n<li><span class=\"accentue\">EUCC Les Planes del Rei<\/span>: <span class=\"accentue\">Christian Peuman<\/span>, President.<\/li>\n<\/ul>\n<h2>3) Key clauses of the convenio<\/h2>\n<ul>\n<li><span class=\"accentue\">Water management (collection)<\/span>: the municipality assumes responsibility for the <span class=\"accentue\">collection<\/span> of water bills <em>without assuming ownership of the facilities<\/em> (which remain under the EUCC) until the urbanisation is <span class=\"accentue\">formally received<\/span>.<\/li>\n<li><span class=\"accentue\">Waste<\/span>: the municipality ensures <span class=\"accentue\">collection<\/span> and <span class=\"accentue\">billing<\/span> directly to property owners.<\/li>\n<li><span class=\"accentue\">Meter readings<\/span>: the EUCC must provide the municipality with readings for <span class=\"accentue\">2008\u20132009<\/span> (deadline: <span class=\"accentue\">31\/12\/2009<\/span>). From <span class=\"accentue\">2010<\/span> onwards, the municipality will carry out readings <em>only if<\/em> the meters are accessible from the public road; otherwise, the EUCC must continue to provide <span class=\"accentue\">quarterly<\/span> data (deadline: <span class=\"accentue\">15 days<\/span> after the end of the quarter).<\/li>\n<li><span class=\"accentue\">Ordinary expenses<\/span> (charged to property owners): electricity, chlorination, <span class=\"accentue\">ACA levy<\/span>, mandatory analyses.<\/li>\n<li><span class=\"accentue\">Extraordinary expenses<\/span>: repairs, maintenance of the network\/wells\/equipment remain the responsibility of the <span class=\"accentue\">EUCC<\/span>.<\/li>\n<li><span class=\"accentue\">Possible subsidy<\/span>: in case of a <span class=\"accentue\">surplus<\/span> (income \u2013 ordinary expenses), the municipality may subsidise EUCC maintenance <em>within the limit<\/em> of this surplus.<\/li>\n<li><span class=\"accentue\">Meter compliance<\/span>: property owners are obliged to relocate their meter <span class=\"accentue\">outside<\/span> within <span class=\"accentue\">3 months<\/span>; otherwise, a <span class=\"accentue\">maximum tariff<\/span> will be applied on estimated consumption (according to the municipal ordinance).<\/li>\n<li><span class=\"accentue\">Payment<\/span>: by bank direct debit or cash through <span class=\"accentue\">BASE (Diputaci\u00f3 de Tarragona)<\/span>.<\/li>\n<li><span class=\"accentue\">Well energy<\/span>: the municipality commits to intervening with <span class=\"accentue\">FECSA-ENDESA<\/span> to adjust the contracted power of the pumps.<\/li>\n<\/ul>\n<h2>4) Critical analysis<\/h2>\n<ol>\n<li><span class=\"accentue\">Partial compliance<\/span>: the municipality manages billing and collection but <em>does not assume<\/em> ownership\/maintenance of infrastructures; this <span class=\"accentue\">shifts<\/span> structural costs to the EUCC despite the principle of <span class=\"accentue\">minimum services<\/span>.<\/li>\n<li><span class=\"accentue\">Hybrid responsibilities<\/span>: municipal billing, private infrastructure; in case of breakdown or non-compliance, the chain of responsibility remains <span class=\"accentue\">unclear<\/span>.<\/li>\n<li><span class=\"accentue\">Political effect<\/span>: the municipality shows that it \u201cmanages\u201d the daily service without bearing the <span class=\"accentue\">investment<\/span>; the EUCC remains the financial \u201cbuffer\u201d.<\/li>\n<li><span class=\"accentue\">Pressure on residents<\/span>: obligation to relocate meters and penalties in case of non-compliance; financial and logistical burden for property owners.<\/li>\n<li><span class=\"accentue\">Strategic timing<\/span>: this type of convenio allows <span class=\"accentue\">deferring<\/span> the <span class=\"accentue\">formal reception<\/span> of the urbanisation and thus the full assumption of municipal obligations.<\/li>\n<\/ol>\n<h2>5) Consequences for property owners<\/h2>\n<ul>\n<li><span class=\"accentue\">Payment to the municipality<\/span> for services (water\/waste) without any guarantee that <span class=\"accentue\">network maintenance<\/span> will be assumed by it.<\/li>\n<li><span class=\"accentue\">Possible works<\/span> to ensure meter accessibility (<span class=\"accentue\">3 months<\/span>).<\/li>\n<li><span class=\"accentue\">Tariff risk<\/span>: application of the maximum rate in case of non-compliance.<\/li>\n<\/ul>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>Conclusion<\/h2>\n<p>The convenio of <span class=\"accentue\">10\/09\/2009<\/span> formalises a <span class=\"accentue\">limited municipal management<\/span> (billing\/collection) while <span class=\"accentue\">maintaining<\/span> the <span class=\"accentue\">EUCC<\/span> as responsible for infrastructures and extraordinary expenses.
