The document specifically refers to the <span class=\"accentue\">February 23, 2009<\/span> session of the <span class=\"accentue\">Junta de Govern Local<\/span> (urbanization project) and the decision of the <span class=\"accentue\">March 6, 2009<\/span> Governing Council.<\/p>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>1) Nature of the document<\/h2>\n<ul>\n<li><span class=\"accentue\">Official letter<\/span> issued by the <span class=\"accentue\">Comisi\u00f3n de Gobierno<\/span> (Governing Commission) of the Pratdip Town Hall.<\/li>\n<li>Addressed to the <span class=\"accentue\">Governing Council<\/span> of the <span class=\"accentue\">EUCC Les Planes del Rei<\/span>.<\/li>\n<li>Urban planning context: <span class=\"accentue\">approval<\/span> of the <span class=\"accentue\">urbanization project<\/span> by the <span class=\"accentue\">Junta de Govern Local<\/span> on <span class=\"accentue\">02\/23\/2009<\/span>.<\/li>\n<\/ul>\n<h2>2) Content and decisions<\/h2>\n<ul>\n<li><span class=\"accentue\">Expulsion of \u00d3scar Serrano<\/span>: on <span class=\"accentue\">03\/06\/2009<\/span>, the Governing Council decided to <span class=\"accentue\">exclude<\/span> <span class=\"accentue\">Councilor \u00d3scar Serrano<\/span>, the municipal representative within the EUCC, from its meetings.<\/li>\n<li>The Town Hall deemed this decision <span class=\"accentue\">null and void<\/span>, contrary to urban planning legislation, and likely to entail <span class=\"accentue\">personal liabilities<\/span> for the members who voted in favor.<\/li>\n<li>The Town Hall interpreted this exclusion as a <span class=\"accentue\">rupture of relations<\/span> by the Governing Council; it therefore declared itself <span class=\"accentue\">released<\/span> from any obligations beyond those <span class=\"accentue\">strictly imposed by law<\/span>.<\/li>\n<li><span class=\"accentue\">Non-reception of the urbanization<\/span>: the Town Hall recalled that <span class=\"accentue\">services<\/span> must be <span class=\"accentue\">brought up to standard<\/span> and <span class=\"accentue\">formally transferred<\/span> to the municipality before any municipal takeover.<\/li>\n<li><span class=\"accentue\">Drinking water<\/span>: the letter reproached the EUCC for its intention not to ensure the <span class=\"accentue\">supply of drinking water<\/span> with the required <span class=\"accentue\">health controls<\/span> and warned of <span class=\"accentue\">immediate criminal liability<\/span> in case of a public health incident.<\/li>\n<li><span class=\"accentue\">Household waste<\/span>: requirement to transmit the <span class=\"accentue\">waste census<\/span> and <span class=\"accentue\">bank details<\/span> of property owners for <span class=\"accentue\">billing<\/span> the service; due to lack of cooperation, the Town Hall noted the <span class=\"accentue\">impossibility<\/span> of enforcing the <span class=\"accentue\">TSJC ruling<\/span> of <span class=\"accentue\">January 25, 2009<\/span> (the <span class=\"accentue\">Fenouillet<\/span> case).<\/li>\n<li><span class=\"accentue\">Perspective of dissolution<\/span>: the Town Hall announced steps to bring services into compliance with the law, <span class=\"accentue\">transfer<\/span> them to the municipality, and achieve the <span class=\"accentue\">dissolution<\/span> of the EUCC, with the aim of <span class=\"accentue\">equal treatment<\/span> between Planas del Rey and the urban core of Pratdip.<\/li>\n<\/ul>\n<h2>3) Analysis<\/h2>\n<ul>\n<li>The <span class=\"accentue\">expulsion of the municipal representative<\/span> (\u00d3.
