header_3_font_size_phone=&#8221;23px&#8221; header_3_font_size_last_edited=&#8221;on|desktop&#8221; global_colors_info=&#8221;{}&#8221; sticky_enabled=&#8221;0&#8243;]<\/p>\n<p>Project of an <span class=\"accentue\">urban collaboration agreement<\/span> between the <span class=\"accentue\">Municipality of Pratdip<\/span> and the <span class=\"accentue\">EUCC of Planas del Rey<\/span> (Urban Conservation Collaborative Entity), aimed at regulating the <span class=\"accentue\">reurbanization<\/span> of the development to allow its <span class=\"accentue\">official reception<\/span> by the municipality, followed by the <span class=\"accentue\">dissolution of the EUCC<\/span>.<\/p>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>1) Nature of the document<\/h2>\n<ul>\n<li><span class=\"accentue\">Proposal for Agreement to the Pleno (2007)<\/span>: deliberation submitted to the municipal council.<\/li>\n<li>Main annex: <span class=\"accentue\">draft agreement<\/span> (convenio) defining procedures, responsibilities, and financing.<\/li>\n<li>Legal framework: <span class=\"accentue\">Text Ref\u00f2s de la Llei d\u2019Urbanisme (DL 1\/2005)<\/span> and <span class=\"accentue\">Law on Public Administration Contracts<\/span>.<\/li>\n<\/ul>\n<h2>2) Actors and representation<\/h2>\n<ul>\n<li><span class=\"accentue\">Municipality of Pratdip<\/span>: <span class=\"accentue\">Josep Montan\u00e9 i Vidal<\/span>, <span class=\"accentue\">Mayor-President<\/span>.<\/li>\n<li><span class=\"accentue\">EUCC Planas del Rei<\/span>: <span class=\"accentue\">Christian Peuman<\/span>, <span class=\"accentue\">President<\/span>.<\/li>\n<\/ul>\n<h2>3) Context and objectives<\/h2>\n<ul>\n<li>The <span class=\"accentue\">EUCC<\/span> was created in <span class=\"accentue\">1987<\/span> (registered in 1988) for the <span class=\"accentue\">temporary maintenance<\/span> of common assets and services.<\/li>\n<li>Agreement to undertake the <span class=\"accentue\">reurbanization<\/span> so that the municipality may <span class=\"accentue\">receive<\/span> the development and proceed with the <span class=\"accentue\">dissolution of the EUCC<\/span>.<\/li>\n<li>The municipality <span class=\"accentue\">accepts<\/span> to integrate land, works, and infrastructure into the <span class=\"accentue\">municipal assets<\/span> after completion and compliance.<\/li>\n<\/ul>\n<h2>4) Main clauses of the agreement<\/h2>\n<ol>\n<li>\n<p><span class=\"accentue\">Change of implementation system<\/span>: from <span class=\"accentue\">compensaci\u00f3n<\/span> to <span class=\"accentue\">cooperaci\u00f3n<\/span>. The municipality manages the procedure and execution, under current urban planning regulations.<\/p>\n<\/li>\n<li>\n<p><span class=\"accentue\">Financing<\/span>: <span class=\"accentue\">entirely borne by the property owners<\/span> (works, technical project, supervision, health &#038; safety). Collection based on the <span class=\"accentue\">shares<\/span> already used by the EUCC.<\/p>\n<\/li>\n<li>\n<p><span class=\"accentue\">Tendering procedure<\/span>: open tender (<span class=\"accentue\">subasta<\/span>). Strict contractual deadlines; penalties for delays (reference to <span class=\"accentue\">art. 95 TRLCAP<\/span>). No <span class=\"accentue\">partial reception<\/span>; corrections required before acceptance.<\/p>\n<\/li>\n<li>\n<p><span class=\"accentue\">Monitoring committee<\/span>: 5 members (the <span class=\"accentue\">mayor<\/span>, <span class=\"accentue\">two<\/span> municipal representatives, <span class=\"accentue\">two<\/span> from the EUCC). Functions: <span class=\"accentue\">monitoring and prior information<\/span> (modifications, awards, certifications, reception, guarantees). Decisions are <span class=\"accentue\">not binding<\/span> for the municipality.<\/p>\n<\/li>\n<li>\n<p><span class=\"accentue\">Reception &#038; dissolution<\/span>: after <span class=\"accentue\">full reception<\/span>, the municipality records the assets in its <span class=\"accentue\">municipal inventory<\/span> and initiates the <span class=\"accentue\">dissolution of the EUCC<\/span>. The municipality then assumes <span class=\"accentue\">maintenance<\/span>.<\/p>\n<\/li>\n<li>\n<p><span class=\"accentue\">Urban planning compatibility<\/span>: adaptation of the <span class=\"accentue\">POUM<\/span> if necessary; preservation of current <span class=\"accentue\">land uses<\/span>.<\/p>\n<\/li>\n<\/ol>\n<h2>5) Payment terms<\/h2>\n<ul>\n<li><span class=\"accentue\">At award<\/span>: engineering project paid + <span class=\"accentue\">35%<\/span> of works amount.<\/li>\n<li><span class=\"accentue\">+ 12 months<\/span> after the Replanteo Act: <span class=\"accentue\">15%<\/span>.<\/li>\n<li><span class=\"accentue\">+ 18 months<\/span> after the Replanteo Act: <span class=\"accentue\">15%<\/span>.<\/li>\n<li><span class=\"accentue\">At final reception<\/span>: balance up to <span class=\"accentue\">100%<\/span>. The declared goal is the <span class=\"accentue\">reception<\/span> of the development and then the <span class=\"accentue\">dissolution of the EUCC<\/span>.
