header_3_font_size_phone=&#8221;23px&#8221; header_3_font_size_last_edited=&#8221;on|desktop&#8221; global_colors_info=&#8221;{}&#8221; sticky_enabled=&#8221;0&#8243;]<\/p>\n<p>On <span class=\"accentue\">August 9, 2002<\/span>, the <span class=\"accentue\">Entitat Urban\u00edstica Col\u00b7laboradora de Conservaci\u00f3 (EUCC)<\/span> of <span class=\"accentue\">Planes del Rei<\/span>, represented by <span class=\"accentue\">Ren\u00e9 Mimouni<\/span>, and the <span class=\"accentue\">Municipality of Pratdip<\/span>, represented by <span class=\"accentue\">Josep Fortuny<\/span>, signed an <span class=\"accentue\">urban planning agreement<\/span> in order to legally secure the ownership and management of the common areas of <span class=\"accentue\">Planas del Rey (Planes del Rei)<\/span>.<\/p>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>1) Nature of the document<\/h2>\n<ul>\n<li>Administrative agreement (\u201c<span class=\"accentue\">urban planning agreement<\/span>\u201d) covering the period <span class=\"accentue\">until the formal reception<\/span> of the urbanization.<\/li>\n<li>Parties: <span class=\"accentue\">EUCC<\/span> (Ren\u00e9 Mimouni) and <span class=\"accentue\">Municipality of Pratdip<\/span> (Mayor Josep Fortuny).<\/li>\n<li>Purpose: to clarify the effects of the <span class=\"accentue\">land registry entry<\/span> of the common areas in the name of the municipality and to organize transitional management.<\/li>\n<\/ul>\n<h2>2) Legal background recalled<\/h2>\n<ul>\n<li>Urbanization launched in the 1960s by <span class=\"accentue\">Francis Lebasque<\/span>, left <span class=\"accentue\">unfinished<\/span>.<\/li>\n<li><span class=\"accentue\">1968<\/span>: suspension of payments by the developer; the common areas remained registered in his name.<\/li>\n<li><span class=\"accentue\">1993<\/span>: ruling of <span class=\"accentue\">Falset<\/span> obliging the free transfer of the common areas to the municipality.<\/li>\n<li><span class=\"accentue\">2001<\/span>: <span class=\"accentue\">enforcement proceedings<\/span> (art. 708 LEC); <span class=\"accentue\">judicial registration<\/span> of the common areas in the name of the municipality.<\/li>\n<\/ul>\n<h2>3) Essential content of the agreement (\u201cPactes\u201d)<\/h2>\n<ul>\n<li><span class=\"accentue\">Ownership \u2260 Reception<\/span>: registration in the name of the municipality <em>does not amount to<\/em> the <span class=\"accentue\">administrative reception<\/span> of the works.<\/li>\n<li><span class=\"accentue\">Authorization of occupation<\/span>: the municipality authorizes the EUCC to occupy and manage the <span class=\"accentue\">finca registral 1169<\/span> (Property Registry of <span class=\"accentue\">Falset<\/span>) for conservation, maintenance, use of common services, and <span class=\"accentue\">completion<\/span> of the works.<\/li>\n<li><span class=\"accentue\">Commitment of the EUCC<\/span>: the EUCC undertakes to ensure the <span class=\"accentue\">upkeep<\/span>, <span class=\"accentue\">maintenance<\/span>, and <span class=\"accentue\">completion<\/span> of the urbanization works.<\/li>\n<\/ul>\n<h2>4) Legal scope<\/h2>\n<ul>\n<li><span class=\"accentue\">Legal security<\/span>: to prevent private third parties from claiming common lands already in use by everyone.<\/li>\n<li><span class=\"accentue\">Distinction<\/span> between ownership\/reception: the municipality is the owner but the <span class=\"accentue\">reception<\/span> remains deferred.<\/li>\n<li><span class=\"accentue\">Externalization of costs<\/span>: <em>during the transitional phase<\/em>, management and costs remain the responsibility of the EUCC (i.e. the property owners).<\/li>\n<\/ul>\n<h2>5) Controversial points \/ risk areas<\/h2>\n<ul>\n<li>Absence of a <span class=\"accentue\">reception timetable<\/span>: risk of indefinite prolongation of the transitional phase.<\/li>\n<li><span class=\"accentue\">Financial burden<\/span> on property owners for assets already <span class=\"accentue\">municipal<\/span>.<\/li>\n<li>Lack of clarity on the <span class=\"accentue\">precise definition<\/span> of works still to be carried out and their <span class=\"accentue\">completion criteria<\/span>.<\/li>\n<\/ul>\n<h2>6) Conclusion<\/h2>\n<p>The agreement of <span class=\"accentue\">August 9, 2002<\/span> confirms a <span class=\"accentue\">transitional<\/span> situation: the common areas belong to the municipality, but the <span class=\"accentue\">management<\/span> and <span class=\"accentue\">completion<\/span> of the works remain with the EUCC <span class=\"accentue\">until reception<\/span>.
