header_3_font_size_phone=&#8221;23px&#8221; header_3_font_size_last_edited=&#8221;on|desktop&#8221; global_colors_info=&#8221;{}&#8221; sticky_enabled=&#8221;0&#8243;]<\/p>\n<p>On <span class=\"accentue\">29 October 2001<\/span>, the <span class=\"accentue\">Juzgado de Primera Instancia No. 1 of Falset<\/span> (procedure of <span class=\"accentue\">ejecuci\u00f3n de t\u00edtulos judiciales 195\/2001<\/span>) issued an <span class=\"accentue\">auto<\/span> ordering the enforcement of the judgment of <span class=\"accentue\">23 November 1993<\/span> (<em>juicio de menor cuant\u00eda<\/em> 12\/90) concerning the urbanization <span class=\"accentue\">Planas del Rey (Planes del Rei)<\/span>.<br \/>\nJudge <span class=\"accentue\">Victoria Gallego Mart\u00ednez<\/span> \u201cdeemed issued\u201d the declaration of will of the developer in order to complete the free transfer of the common assets to the <span class=\"accentue\">Town Hall of Pratdip<\/span>, pursuant to <span class=\"accentue\">Article 708 of the Ley de Enjuiciamiento Civil<\/span>.<\/p>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>1) Context<\/h2>\n<ul>\n<li><span class=\"accentue\">Claimant<\/span>: Entidad Urban\u00edstica de Conservaci\u00f3n de Les Planes del Rey (EUCC).<\/li>\n<li><span class=\"accentue\">Defendants<\/span>: <span class=\"accentue\">Francis Lebasque<\/span> (developer) and the <span class=\"accentue\">Creditors\u2019 Committee<\/span>.<\/li>\n<li><span class=\"accentue\">Basis<\/span>: enforcement of the <span class=\"accentue\">judgment of 23\/11\/1993<\/span> (menor cuant\u00eda 12\/90).<\/li>\n<\/ul>\n<h2>2) Purpose of the judgment<\/h2>\n<p>To enforce the 1993 judgment which ordered the developer to <span class=\"accentue\">transfer free of charge<\/span> to the municipality the infrastructures and common facilities of <span class=\"accentue\">Planas del Rey<\/span>.<\/p>\n<h2>3) Content of the decision<\/h2>\n<ul>\n<li><span class=\"accentue\">Capacity and legitimacy<\/span> of the EUCC recognized;
