This document formalizes the creation of the entity, <span class=\"accentue\">mandatory<\/span> for all property owners, and transfers to the residents the obligations of conservation and maintenance of collective facilities.<\/p>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>1) Nature and creation<\/h2>\n<ul>\n<li>Administrative association of property owners, of <span class=\"accentue\">legal-administrative<\/span> character, based on articles 24 to 30 and 67 to 70 of the Urban Management Regulation (Land Law of 1978).<\/li>\n<li><span class=\"accentue\">Mandatory<\/span> membership for all property owners (art. 25.3 and 68 of the regulation).<\/li>\n<li><span class=\"accentue\">Indefinite<\/span> duration, except dissolution by the General Assembly and official assumption by the Town Hall.<\/li>\n<\/ul>\n<h2>2) Purpose and functions<\/h2>\n<ul>\n<li><span class=\"accentue\">Conservation, maintenance, and use<\/span> of common services (roads, lighting, green areas, facilities).<\/li>\n<li>Possibility to create new services with municipal authorization.<\/li>\n<li>Representation of property owners before the State, the Generalitat, the Town Hall, and the courts.<\/li>\n<li>Resolution of conflicts among property owners.<\/li>\n<li>Common elements not ceded to the Town Hall remain the responsibility of the property owners.<\/li>\n<\/ul>\n<h2>3) Ownership and obligations<\/h2>\n<ul>\n<li>Full ownership of plots by their holders, but within the limits of the Partial Plan.<\/li>\n<li>Private works authorized only with the approval of the <span class=\"accentue\">Consejo Rector<\/span>.<\/li>\n<li>Common elements are <span class=\"accentue\">indivisible<\/span> and attached to each private property.<\/li>\n<li>In case of sale, the buyer is automatically <span class=\"accentue\">subrogated<\/span> to the rights and obligations.<\/li>\n<\/ul>\n<h2>4) Financing<\/h2>\n<ul>\n<li>Each property owner contributes according to the size of their plot.<\/li>\n<li>Shops and restaurants pay a triple coefficient.<\/li>\n<li>Sanctions for non-payment: late interest, temporary exclusion from services, water cut-off, legal action.<\/li>\n<li>The EUCC may request the <span class=\"accentue\">Town Hall of Pratdip<\/span> to recover debts through administrative enforcement (art. 70 of the 1978 Regulation).<\/li>\n<\/ul>\n<h2>5) Organization and governance<\/h2>\n<ul>\n<li><span class=\"accentue\">General Assembly<\/span>: annual meeting in August, sovereign body of the entity.<\/li>\n<li><span class=\"accentue\">Consejo Rector<\/span>: at least 9 members, 3-year term, revocable by the Assembly.<\/li>\n<li>Board: President, Vice-President, Secretary, Treasurer.<\/li>\n<li>Powers: execution of decisions, management of services, sanctions, legal representation, hiring of staff.<\/li>\n<\/ul>\n<h2>6) Rights and obligations of property owners<\/h2>\n<ul>\n<li>Obligation to belong to the EUCC and comply with its decisions.<\/li>\n<li>Temporary loss of services in case of non-payment, while still being required to contribute.<\/li>\n<li>Right of administrative appeal before the <span class=\"accentue\">Town Hall of Pratdip<\/span> against EUCC decisions.<\/li>\n<\/ul>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>Legal scope and implications<\/h2>\n<p>These statutes formalize the <span class=\"accentue\">imposition of a mandatory entity<\/span> on the property owners of Las Planas del Rey. They assign to the EUCC the <span class=\"accentue\">maintenance of infrastructures<\/span> (roads, lighting, services) normally borne by the municipality. The possibility of debt collection through the Town Hall of Pratdip illustrates the <span class=\"accentue\">quasi-public<\/span> nature of the entity, which acted as a <span class=\"accentue\">shield<\/span> to avoid the reception of the urbanization.
