This document clarifies the <span class=\"accentue\">legal status<\/span> of the entity and the <span class=\"accentue\">obligations of the owners<\/span>.<\/p>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>1) Question raised by the EUCC<\/h2>\n<ul>\n<li>Whether the entity had been established in a <span class=\"accentue\">mandatory<\/span> or <span class=\"accentue\">voluntary<\/span> manner.<\/li>\n<li>What the <span class=\"accentue\">legal implications<\/span> were for the owners.<\/li>\n<\/ul>\n<h2>2) Response from the Generalitat<\/h2>\n<h3>Mandatory constitution<\/h3>\n<p>The <span class=\"accentue\">Entitat de Conservaci\u00f3 of Les Planes del Rei<\/span> was established with a <span class=\"accentue\">mandatory character<\/span> by decision of the <span class=\"accentue\">Plenary of the Pratdip Town Hall<\/span> on <span class=\"accentue\">July 24, 1987<\/span>.<\/p>\n<p>This decision was based on:<\/p>\n<ul>\n<li>The <span class=\"accentue\">third transitional provision<\/span> of Law 9\/1981 of November 18 on the protection of urban planning legality.<\/li>\n<li><span class=\"accentue\">Article 25<\/span> of the Urban Management Regulation of August 25, 1978.<\/li>\n<\/ul>\n<h3>Obligations of the owners<\/h3>\n<p>\u201cThe <span class=\"accentue\">owners of the land<\/span> included within the scope of action of the Entity are <span class=\"accentue\">obliged to maintain<\/span> the urbanization works.\u201d<\/p>\n<ul>\n<li>This obligation is <span class=\"accentue\">independent<\/span> of whether the owner participated in the creation of the EUCC.<\/li>\n<li>The obligation is <span class=\"accentue\">legal and automatic<\/span>.<\/li>\n<li>In the case of a sale, the buyer is <span class=\"accentue\">automatically subrogated<\/span> to this obligation.<\/li>\n<\/ul>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>3) Legal scope<\/h2>\n<ul>\n<li>The Town Hall <span class=\"accentue\">imposed<\/span> the EUCC without consulting the owners, which is legal but a source of tensions.<\/li>\n<li>The EUCC was established to <span class=\"accentue\">compensate for the lack of assumption<\/span> by the Town Hall, despite the attempt to integrate the roads between July 1986 and May 1987.<\/li>\n<li>The document confirms the <span class=\"accentue\">transfer of maintenance responsibility<\/span> to the owners, within the framework of an official <span class=\"accentue\">non-reception by the municipality<\/span>.<\/li>\n<\/ul>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h3 class=\"underline\">Document<\/h3>\n<p style=\"padding-top: 30px;\"><a href=\"https:\/\/www.latribunedeplanas.com\/wp-content\/uploads\/2025\/08\/1987-07-24-reponse-generalitat-a-euc.pdf\" class=\"pdfemb-viewer\" style=\"\" data-width=\"max\" data-height=\"max\" data-mobile-width=\"0\"  data-scrollbar=\"none\" data-download=\"on\" data-tracking=\"on\" data-newwindow=\"on\" data-pagetextbox=\"off\" data-scrolltotop=\"off\" data-startzoom=\"100\" data-startfpzoom=\"100\" data-toolbar=\"top\" data-toolbar-fixed=\"off\">1987-07-24-reponse-generalitat-a-euc<br\/><\/a><\/p>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][\/et_pb_section]<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Official legal report drafted by the Generalitat at the request of the Entitat de Conservaci\u00f3 of the urbanization Les Planes del Rei.
