header_3_font_size_last_edited=&#8221;on|desktop&#8221; global_colors_info=&#8221;{}&#8221; sticky_enabled=&#8221;0&#8243;]<\/p>\n<p>Following the agreement of the <span class=\"accentue\">Comissi\u00f3 d\u2019Urbanisme de Tarragona<\/span> dated <span class=\"accentue\">July 23, 1986<\/span> and the municipal notification of <span class=\"accentue\">August 25, 1986<\/span>, the <span class=\"accentue\">Community of Owners of Les Planes del Rei<\/span> officially responds to the <span class=\"accentue\">Pratdip Town Hall<\/span> regarding the <span class=\"accentue\">free transfers<\/span> of roads and public facilities of the <span class=\"accentue\">Planas del Rey (Planes del Rei)<\/span> development.<\/p>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>1) Nature of the document<\/h2>\n<ul>\n<li><span class=\"accentue\">Official<\/span> response from the Community of Owners to the Town Hall.<\/li>\n<li>Signed by: <span class=\"accentue\">Vicente Garc\u00eda Montgui\u00f3<\/span>, vice president.<\/li>\n<li>Subject: in response to the notification of <span class=\"accentue\">08\/25\/1986<\/span> requiring the formalization of the transfers.<\/li>\n<\/ul>\n<h2>2) Administrative context<\/h2>\n<ul>\n<li><span class=\"accentue\">07\/23\/1986<\/span>: the Comissi\u00f3 d\u2019Urbanisme required the transfers to be made within three months.<\/li>\n<li><span class=\"accentue\">08\/25\/1986<\/span>: the Town Hall formally notified the Community.<\/li>\n<li><span class=\"accentue\">11\/20\/1986<\/span>: the Community replied with the present letter.<\/li>\n<\/ul>\n<h2>3) Content of the response (11\/20\/1986)<\/h2>\n<ul>\n<li>Acknowledges the agreement of <span class=\"accentue\">07\/23\/1986<\/span> and the obligation to formalize the transfers.<\/li>\n<li>Position: the Community <span class=\"accentue\">is not the owner<\/span> of the land to be transferred.<\/li>\n<li>Indicates that the land is registered under the name of <span class=\"accentue\">Francisca<\/span> (sic) \/ <span class=\"accentue\">Francisco Lebasque<\/span>, in <span class=\"accentue\">suspensi\u00f3n de pagos<\/span> (suspension of payments).<\/li>\n<li>Conclusion: the transfers must be carried out by the <span class=\"accentue\">legal owner<\/span> (Lebasque), not by the Community.<\/li>\n<\/ul>\n<h2>4) Scope and evidentiary value<\/h2>\n<ul>\n<li><span class=\"accentue\">Explicit acknowledgment<\/span> by the Community of the absence of ownership title.<\/li>\n<li><span class=\"accentue\">Official blockage<\/span> of the transfer procedure within the required three-month period.<\/li>\n<li>The 1986 failure was mainly due to the <span class=\"accentue\">bankruptcy of the developer<\/span>, and not to a refusal by the co-owners.<\/li>\n<\/ul>\n<h2>5) Key points<\/h2>\n<ul>\n<li>Letter of <span class=\"accentue\">November 20, 1986<\/span>: key document establishing the impossibility of transferring \u201cwhat one does not own.\u201d<\/li>\n<li>Responsibility for the transfer: <span class=\"accentue\">F.
