Gobernaci\u00f3n<\/span> (Ministry of the Interior) \u2014 via the <span class=\"accentue\">Servicio Nacional de Inspecci\u00f3n y Asesoramiento de las Corporaciones Locales<\/span> \u2014 replied to the <span class=\"accentue\">Pratdip<\/span> Town Hall regarding the <span class=\"accentue\">transfer of roads and services<\/span> of the <span class=\"accentue\">Planas del Rey (Planes del Rei)<\/span> urbanization, requested by the developer <span class=\"accentue\">Francisco Lebasque Belloncle<\/span> and various property owners.<\/p>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>1) Nature and scope of the document<\/h2>\n<ul>\n<li><span class=\"accentue\">Type<\/span>: administrative response (preliminary technical opinion).<\/li>\n<li><span class=\"accentue\">Issuer<\/span>: Ministerio de la Gobernaci\u00f3n \u2014 Service of Inspection and Advice for Local Corporations.<\/li>\n<li><span class=\"accentue\">Recipient<\/span>: Mayor of Pratdip.<\/li>\n<li><span class=\"accentue\">Reference<\/span>: s\/o 540 of <span class=\"accentue\">December 23, 1968<\/span>.<\/li>\n<li><span class=\"accentue\">Subject<\/span>: possibility for the municipality to <span class=\"accentue\">accept the transfer<\/span> of existing roads and services in Planas del Rey.<\/li>\n<\/ul>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>2) Legal basis recalled<\/h2>\n<ul>\n<li><span class=\"accentue\">Local Government Law (Art. 6)<\/span>: municipalities have the capacity to <span class=\"accentue\">acquire property<\/span>.<\/li>\n<li><span class=\"accentue\">Land Law (Art. 129)<\/span>: the <span class=\"accentue\">transfer of roads<\/span> is an <span class=\"accentue\">essential condition<\/span> for any urbanization.<\/li>\n<\/ul>\n<p>In summary, the legal framework <span class=\"accentue\">in principle allows<\/span> the acceptance of the transfer.<\/p>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>3) Finding of an incomplete file<\/h2>\n<ul>\n<li>Absence of <span class=\"accentue\">supporting documents<\/span> accompanying the request.<\/li>\n<li>No <span class=\"accentue\">certification of the municipal agreement of October 18, 1968<\/span>.<\/li>\n<li>Lack of <span class=\"accentue\">plans<\/span>, <span class=\"accentue\">technical studies<\/span> and <span class=\"accentue\">inventory<\/span> of the assets and services to be transferred.<\/li>\n<\/ul>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>4) Conditions prior to any acceptance<\/h2>\n<p>The Town Hall must have:<\/p>\n<ul>\n<li>The <span class=\"accentue\">conditions set<\/span> when authorizing the urbanization (<span class=\"accentue\">Art. 42 of the Land Law<\/span>).<\/li>\n<li>The <span class=\"accentue\">precise content<\/span> of the transfer proposal.<\/li>\n<li>The <span class=\"accentue\">plans<\/span> and <span class=\"accentue\">complementary studies<\/span>.<\/li>\n<\/ul>\n<p>And above all, a <span class=\"accentue\">detailed inventory<\/span> including:<\/p>\n<ul>\n<li><span class=\"accentue\">Surface area<\/span> and <span class=\"accentue\">boundaries<\/span> of the roads.<\/li>\n<li><span class=\"accentue\">Nature<\/span> and <span class=\"accentue\">condition<\/span> of the installed services.<\/li>\n<li><span class=\"accentue\">Original value<\/span>, <span class=\"accentue\">depreciation<\/span>, <span class=\"accentue\">expected service life<\/span>.<\/li>\n<li><span class=\"accentue\">Investments<\/span> needed for maintenance and conservation.<\/li>\n<li>Possible <span class=\"accentue\">returns<\/span> and technical timelines.<\/li>\n<\/ul>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>5) Analysis<\/h2>\n<p>The Ministry considers that the <span class=\"accentue\">transfer offer may be of interest<\/span> to the municipality, but that <span class=\"accentue\">as it stands<\/span> (incomplete file), <span class=\"accentue\">no conclusion can be reached<\/span> and the Town Hall <span class=\"accentue\">cannot decide<\/span> on such a significant matter.<\/p>\n<p>This letter therefore <span class=\"accentue\">does not approve<\/span> the transfer; it <span class=\"accentue\">sets out the conditions<\/span> that must be met for a regular acceptance to be possible.<\/p>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>6) Consequences<\/h2>\n<ul>\n<li>Complete the file with the certified agreement, plans, studies and technical\/economic inventory.<\/li>\n<li>Enable the Administration to <span class=\"accentue\">issue a definitive opinion<\/span>.<\/li>\n<li>Confirm that <span class=\"accentue\">as early as 1968<\/span>, the transfer was legally possible, subject to procedure.<\/li>\n<\/ul>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h3 class=\"underline\">Document<\/h3>\n<p style=\"padding-top: 30px;\"><a
