This lack of regularisation prevents or delays the provision of <span class=\"accentue\">essential public services<\/span> (water, lighting, roads, sanitation), despite residents paying their taxes.<\/p>\n<p>The <span class=\"accentue\">Diputaci\u00f3 de Barcelona<\/span> has identified <span class=\"accentue\">367 urbanisations with deficiencies<\/span> across <span class=\"accentue\">118 municipalities<\/span>. Since 2018, only about ten of them have been regularised and integrated into municipal networks. The figures speak for themselves:<\/p>\n<ul>\n<li><span class=\"accentue\">83%<\/span> have little or no basic services.<\/li>\n<li><span class=\"accentue\">74%<\/span> have no shops.<\/li>\n<li><span class=\"accentue\">50%<\/span> lack public facilities.<\/li>\n<li><span class=\"accentue\">20%<\/span> are located in non-developable areas (natural parks, etc.).<\/li>\n<\/ul>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>Planas del Rey: a typical\u2026 and aggravated case<\/h2>\n<p>Planas del Rey perfectly illustrates this structural problem, but with aggravating factors. Here, the <span class=\"accentue\">former EUCC<\/span> (Entitat Urban\u00edstica Col\u00b7laboradora de Conservaci\u00f3) was <a href=\"https:\/\/www.latribunedeplanas.com\/en\/sentence-of-the-superior-court-of-justice-of-catalonia\/\">dissolved in 2016<\/a> after being declared illegal. Nevertheless, the municipality of Pratdip still refuses to provide minimum services, claiming that the urbanisation is not \u201cintegrated\u201d.<\/p>\n<p>This blockage is not only technical or financial: it is also <span class=\"accentue\">political<\/span>. For years, the town hall has relied on the absence of official reception to evade its obligations, despite legal provisions requiring these services in inhabited areas.<\/p>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>A new legal framework: Decree-law 2\/2025<\/h2>\n<p>In force since <span class=\"accentue\">27 February 2025<\/span>, the Catalan government\u2019s <span class=\"accentue\">Decree-law 2\/2025<\/span> brings major changes:<\/p>\n<ul>\n<li>It now allows municipalities to provide <span class=\"accentue\">minimum services<\/span> even in <span class=\"accentue\">non-developable<\/span> areas.<\/li>\n<li>It authorises the implementation of <span class=\"accentue\">autonomous solutions<\/span> (such as collective septic tanks) when connection to a public network is impossible.<\/li>\n<li>It opens the door to <span class=\"accentue\">progressive receptions<\/span> of infrastructure, avoiding owners having to bear all the costs at once.<\/li>\n<li>It strengthens <span class=\"accentue\">transparency<\/span> by requiring municipalities to publish their urban planning in a register accessible to all.<\/li>\n<\/ul>\n<p>In practical terms, for Planas del Rey, this means that <span class=\"accentue\">there is no longer any serious legal basis for refusing minimum services<\/span>. The problem is no longer proving the right: it is now <span class=\"accentue\">forcing the town hall to apply the law<\/span>.<\/p>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>What now?<\/h2>\n<p>This new legal framework opens up avenues for action:<\/p>\n<ul>\n<li>Demand the <span class=\"accentue\">official publication<\/span> of Planas del Rey\u2019s urbanistic status.<\/li>\n<li>Request a <span class=\"accentue\">progressive reception<\/span> of infrastructure.<\/li>\n<li>Use <span class=\"accentue\">case law<\/span> and the provisions of the decree-law to support an administrative or legal appeal.<\/li>\n<li>Mobilise public opinion by stressing that Planas is not an isolated case but an emblematic example of a \u201csecond-class\u201d urbanisation that the law now makes possible to regularise.<\/li>\n<\/ul>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>Conclusion<\/h2>\n<p>The <em>El Punt Avui<\/em> article reminds us that Planas del Rey is part of a problem affecting all of Catalonia. But with <span class=\"accentue\">Decree-law 2\/2025<\/span>, the law has now shifted in favour of the residents: <span class=\"accentue\">minimum services can and must be provided<\/span>.
