Demanding minimum public services: a legal obligation, not a favor<\/h2>\n<p>The Catalan law is clear: <span class=\"accentue\">all municipalities must provide essential public services<\/span> in inhabited areas, <span class=\"accentue\">including in non-received urbanizations<\/span> such as Las Planas del Rey.<\/p>\n<p>Among these mandatory services:<\/p>\n<ul>\n<li>drinking water<\/li>\n<li>sanitation<\/li>\n<li>waste collection<\/li>\n<li>public lighting<\/li>\n<li>road maintenance<\/li>\n<li>access to the area<\/li>\n<\/ul>\n<p>However, the Pratdip Town Hall continues to refuse this responsibility. In the face of this blatant violation, SOS Planas will file a <span class=\"accentue\">criminal complaint<\/span>, supported by a <span class=\"accentue\">technical report by an architect specialized in environmental urban planning<\/span>, demonstrating the lack of services.<\/p>\n<p class=\"accentue\">Our goal: to have the Town Hall\u2019s legal obligation to provide these services to its residents recognized in court.<\/p>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>2. Yes to reurbanization, but under public control<\/h2>\n<p>SOS Planas is not opposed to the works. On the contrary.<br \/>\nWe support the project of <span class=\"accentue\">&#8220;rehabilitation of the urbanization of Las Planas del Rey<\/span>, estimated at approximately <span class=\"accentue\">11 million euros<\/span>.<\/p>\n<p>But under several conditions:<\/p>\n<ul>\n<li>That the works be <span class=\"accentue\">led by the Pratdip Town Hall<\/span> or the <span class=\"accentue\">Tarragona Provincial Council<\/span>, not by a parallel entity.<\/li>\n<li>That they be carried out <span class=\"accentue\">in phases<\/span>, according to priorities and available resources.<\/li>\n<li>That they be <span class=\"accentue\">integrated into an official roadmap<\/span> toward the integration of the urbanization into the public network.<\/li>\n<li>And above all, <span class=\"accentue\">residents of Planas must not bear 100% of the costs alone<\/span>.<\/li>\n<\/ul>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>3. NO to a new EUCC or administrative entity: never again<\/h2>\n<p>There is no question of repeating past mistakes.<br \/>\nThe Town Hall has hinted at a <span class=\"accentue\">new EUCC<\/span> or an <span class=\"accentue\">equivalent administrative association<\/span>, under the pretext of managing future reurbanization works.<\/p>\n<p class=\"accentue\">We say NO.<\/p>\n<p>Such a structure would take us back <span class=\"accentue\">30 years<\/span>, to a system of <span class=\"accentue\">fiscal injustice<\/span>: double taxation, opacity, non-democratic parallel management.<\/p>\n<p>We reject any form of <span class=\"accentue\">&#8220;double taxation<\/span>: that is, co-ownership charges (quotas) added to the property tax (IBI).<\/p>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>4. Refund of charges illegally collected for 23 years<\/h2>\n<p>Between 1993 and 2016, Planas property owners paid approximately <span class=\"accentue\">5 million euros to an illegal entity<\/span>, according to the Catalan justice system.<\/p>\n<p class=\"accentue\">The EUCC: an entity created for 2 years, illegally extended for 28 years.<\/p>\n<p>Created by the Town Hall in April 1988, the EUCC was intended to support the completion of infrastructure. According to urban planning regulations and the 2016 TSJC ruling, this type of entity <span class=\"accentue\">may not exist for more than 5 years<\/span>.<\/p>\n<p>However, in Planas, the urbanization was already <span class=\"accentue\">85\u00a0%<\/span> complete according to contemporary documents.<br \/>\nAnd yet, the EUCC continued <span class=\"accentue\">until 2016<\/span>, without any legal basis.<\/p>\n<p>For 23 years, property owners were subjected to <span class=\"accentue\">illegitimate double taxation<\/span>:<\/p>\n<ul>\n<li>IBI (property tax) paid to the Town Hall<\/li>\n<li>quotas paid to the EUCC<\/li>\n<\/ul>\n<p>The EUCC\u2019s role was supposed to be temporary: <span class=\"accentue\">to ensure minimum services while the Town Hall completed the necessary upgrades<\/span>. But the Town Hall <span class=\"accentue\">never fulfilled its part<\/span>.<\/p>\n<p>We therefore demand the refund of amounts paid to the EUCC from 1993 to 2016, that is, at least for the 4 years preceding 2016, the year of the EUCC&#8217;s dissolution.<\/p>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>Conclusion: turn the page, but assert the truth<\/h2>\n<p class=\"accentue\">Property owners acted in good faith: now, justice.<\/p>\n<h3>Some damning figures:<\/h3>\n<ul>\n<li>Approximately <span class=\"accentue\">6 million euros<\/span> paid by residents to the EUCC<\/li>\n<li>That\u2019s an average of <span class=\"accentue\">230,000 euros per year<\/span>, for services the Town Hall should have provided<\/li>\n<li>An additional <span class=\"accentue\">300,000 euros<\/span> paid to the company ACYCSA in 2005 for a reurbanization project<\/li>\n<\/ul>\n<h3>Meanwhile:<\/h3>\n<ul>\n<li>The Town Hall <span class=\"accentue\">did not dissolve the EUCC<\/span>, despite legal obligations<\/li>\n<li>The <span class=\"accentue\">swimming pool<\/span> and the <span class=\"accentue\">wastewater treatment plant (built by the owners at their own expense)<\/span> remained under EUCC control<\/li>\n<li>The Town Hall continued to <span class=\"accentue\">collect IBI<\/span>, while disclaiming all responsibility<\/li>\n<\/ul>\n<h3>Today, we demand:<\/h3>\n<ul>\n<li><span class=\"accentue\">Public services (minimum services), as provided for by <span class=\"accentue\">Article 26 of Law 7\/1985 of April 2, regulating the bases of local government<\/span><\/span><\/li>\n<li>The <span class=\"accentue\">refund of illegally collected charges<\/span><\/li>\n<li><span class=\"accentue\">Public management of future works<\/span>, transparent and accountable<\/li>\n<\/ul>\n<p class=\"accentue\">Association Vecinos de Planes del Rei (SOSPlanes)<\/p>\n<p>[\/et_pb_text][et_pb_text admin_label=&#8221;Texte-Lien&#8221; module_class=&#8221;txt-article&#8221; _builder_version=&#8221;4.27.4&#8243; text_font=&#8221;|300|||||||&#8221; header_font=&#8221;||||||||&#8221; header_2_line_height=&#8221;1.2em&#8221; header_3_font=&#8221;||||||||&#8221; header_3_line_height=&#8221;1.3em&#8221; header_4_text_align=&#8221;center&#8221; custom_padding=&#8221;30px||||false|false&#8221; text_line_height_tablet=&#8221;&#8221; text_line_height_phone=&#8221;1.3em&#8221; text_line_height_last_edited=&#8221;on|desktop&#8221; header_2_font_size_tablet=&#8221;&#8221; header_2_font_size_phone=&#8221;&#8221; header_2_font_size_last_edited=&#8221;on|phone&#8221; header_3_font_size_tablet=&#8221;&#8221; header_3_font_size_phone=&#8221;23px&#8221; header_3_font_size_last_edited=&#8221;on|desktop&#8221; global_colors_info=&#8221;{}&#8221;][\/et_pb_text][\/et_pb_column][\/et_pb_row][\/et_pb_section]<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Faced with the chaos caused by the Town Hall&#8217;s refusal to provide minimum services, the &#8220;Vecinos Les Planes del Rei&#8221; Association (AVPR SOS Planas) is launching a new legal offensive, this time before the criminal court.
