This treaty strictly prohibits systems of double taxation like the one in place in Planas.<\/p>\n<p>To circumvent this ban, the Pratdip Town Hall created in <span class=\"accentue\">July 1987<\/span> an <span class=\"accentue\">EUCC<\/span> (Urbanistic Entity for Collaboration and Conservation).<\/p>\n<p>In <span class=\"accentue\">July 1990<\/span>, the Spanish State limited the existence of EUCCs to <span class=\"accentue\">5 years<\/span>, during which time they were supposed to carry out necessary upgrades prior to the full integration of the urbanisation by the municipality.<\/p>\n<p>However, these works were never carried out in Planas. The Town Hall, which had created the EUCC, failed to respect the law. It should have started the works between <span class=\"accentue\">1988 and 1993<\/span> with financial participation from the owners, and then <span class=\"accentue\">dissolved the EUCC<\/span>.<\/p>\n<p>Instead, the EUCC remained in place until the <span class=\"accentue\">High Court of Justice of Catalonia<\/span> (TSJC) pronounced its <a href=\"https:\/\/www.latribunedeplanas.com\/en\/sentence-of-the-superior-court-of-justice-of-catalonia\/\">dissolution in 2016<\/a>.<\/p>\n<p>Estimated cost of this illegal taxation to property owners between 2006 and 2016: <span class=\"accentue\">around 5 million euros<\/span>.<\/p>\n<hr style=\"margin-bottom:30px;\" \/>\n<h2>Act 2 \u2014 The Legal Battle (2016\u20132022)<\/h2>\n<p>After the official dissolution of the EUCC in 2016, the Town Hall claimed that Planas would fall into an <span class=\"accentue\">administrative vacuum<\/span>.<\/p>\n<p>But <span class=\"accentue\">in law, a vacuum does not exist<\/span>: when an administrative entity (EUCC) is dissolved, responsibility automatically reverts to the entity that created it \u2014 <span class=\"accentue\">the Pratdip Town Hall<\/span>.<\/p>\n<p>Refusing to comply with the 2016 ruling, the Town Hall challenged the interpretation of the enforcement judge, who stated that the 1990 law triggered the automatic dissolution of the EUCC.<\/p>\n<p>The Town Hall\u2019s appeal was rejected in <span class=\"accentue\">2020<\/span> by the TSJC, which fined it <span class=\"accentue\">\u20ac2,000<\/span>. Despite this <a href=\"https:\/\/www.latribunedeplanas.com\/wp-content\/uploads\/2020\/02\/LexNet-tmp9568.Iuritex.44983.pdf\" target=\"_blank\" rel=\"noopener\">conviction<\/a>, the Town Hall persisted:<\/p>\n<ul>\n<li>Refusal to provide <span class=\"accentue\">minimum public services<\/span> (street lighting, road maintenance&#8230;)<\/li>\n<li>Attempt to impose the creation of a new EUCC with a budget of <span class=\"accentue\">\u20ac103,000<\/span> for the first year<\/li>\n<\/ul>\n<p>Faced with this obstinacy, our association <span class=\"accentue\">AVPR \u2013 SOS Planas<\/span> filed a <span class=\"accentue\">criminal complaint<\/span> in 2022 with the Investigating Judge of Reus against the current mayor and her secretary.<\/p>\n<h3>The charges brought:<\/h3>\n<ul>\n<li><span class=\"accentue-maj\">Urban Planning Offense<\/span> (Art. 320.1 of the Penal Code) \u2013 3 years in prison and a \u20ac7,200 fine<\/li>\n<li><span class=\"accentue-maj\">Prevarication by Public Officials<\/span> (Art. 404) \u2013 10-year ban from public office and passive suffrage<\/li>\n<li><span class=\"accentue-maj\">Disobedience to Justice<\/span> (Art. 410.1) \u2013 2-year disqualification and a \u20ac3,600 fine<\/li>\n<\/ul>\n<hr style=\"margin-bottom:30px;\" \/>\n<h2>Conclusion (provisional?)<\/h2>\n<p>With municipal elections approaching, false claims continue to circulate.
