SOS Planas asks Pratdip Town Council not to grant final approval to the project or proceed with its registration at the Falset Land Registry.<\/p>\n<p>In February 2022, Avan\u00e7a Pratdip also prepares a template for individual objections to be submitted by property owners. Several months later, SOS Planas and a group of owners organise a legal challenge before the administrative courts.<\/p>\n<p>The arguments put forward during these proceedings reflect <span class=\"accentue\">the legal position defended by SOS Planas, Avan\u00e7a Pratdip and the participating property owners<\/span>. They do not constitute findings made by an administrative authority or a court.<\/p>\n<hr style=\"margin-bottom:30px;\"\/>\n<h2>A project submitted to public consultation<\/h2>\n<p>On 14 December 2021, Pratdip Town Council publishes a notice in the Official Gazette of the Province of Tarragona concerning an amendment to the second consolidated version of the PAU-4 economic reparcelaci\u00f3n project.<\/p>\n<p>The procedure is intended, among other things, to clarify the status of the plots, distribute development rights and determine the charges that could be allocated to the various property owners.<\/p>\n<p>The municipal document is based on a project whose earliest versions date back to 2012. A new version is approved in 2018, but its registration at the Land Registry encounters a number of technical and legal difficulties.<\/p>\n<hr style=\"margin-bottom:30px;\"\/>\n<h2>SOS Planas files an administrative appeal<\/h2>\n<p>On 29 December 2021, the Les Planes del Rei Residents\u2019 Association, known as SOS Planas, submits a document described as a <em>recurso de alzada<\/em>, or administrative appeal, to the Town Council.<\/p>\n<p>The association asks:<\/p>\n<ul>\n<li>for the amendment to the reparcelaci\u00f3n project not to receive final approval;<\/li>\n<li>for the project not to be registered at the Falset Land Registry;<\/li>\n<li>for the omissions and errors it believes it has identified to be corrected.<\/li>\n<\/ul>\n<p>SOS Planas argues, among other points, that property owners had not received all the information guarantees provided for under planning legislation.<\/p>\n<p>The association also points to a discrepancy between the available documents. According to SOS Planas, the link included in the notice published in the Official Gazette led to a version of the project dated December 2017, whereas the association had a new version dated September 2021.<\/p>\n<p>These statements reflect the arguments presented by the association in its appeal. They do not mean that an administrative authority or court found those arguments to be well founded.<\/p>\n<hr style=\"margin-bottom:30px;\"\/>\n<h2>The dissolution of the EUCC at the heart of the dispute<\/h2>\n<p>The appeal also challenges a section of the municipal project that still referred to an urban conservation entity responsible for maintaining Planas del Rey and distributing expenses among the property owners.<\/p>\n<p>SOS Planas points out that <a href=\"https:\/\/www.latribunedeplanas.com\/en\/sentence-of-the-superior-court-of-justice-of-catalonia\/\">the dissolution of the EUCC had been ordered by the courts in 2016<\/a> and subsequently enforced in 2017. The association therefore argues that the project could no longer present the entity as still being active.<\/p>\n<p>This issue lies at the heart of the dispute. The disappearance of the EUCC raises the question of who must subsequently maintain the infrastructure and how future work can be financed.<\/p>\n<hr style=\"margin-bottom:30px;\"\/>\n<h2>A dispute over transfers and municipal facilities<\/h2>\n<p>SOS Planas also argues that certain roads, green spaces and communal facilities had already been transferred to the Town Council or had been managed by it for several years.<\/p>\n<p>The association relies, among other things, on earlier court decisions concerning the transfer of communal property and on <a href=\"https:\/\/www.latribunedeplanas.com\/en\/summary-of-the-municipal-council-meeting-of-april-9-2021\/\">the partial formal acceptance of the sports and recreational area approved by the Town Council on 9 April 2021<\/a>.<\/p>\n<p>It therefore argues that certain areas and facilities should no longer be regarded as the financial responsibility of the property owners. However, the legal scope of those earlier transfers and their effect on the allocation of costs remain at the centre of the dispute.<\/p>\n<hr style=\"margin-bottom:30px;\"\/>\n<h2>The allocation of future charges is challenged<\/h2>\n<p>At the time, the municipal project estimates the cost of the development works at just over \u20ac7.2 million.<\/p>\n<p>SOS Planas challenges the way in which these expenses could be distributed. The association argues that the Town Council should bear the share corresponding to public land and spaces, which it estimates represent 44.90% of the PAU-4 area.<\/p>\n<p>It also considers that property owners should not have to pay again for facilities or work that had already been completed or transferred in the past.<\/p>\n<p>These calculations and this interpretation are those presented by the association in its appeal. They do not constitute a financial allocation adopted by the Town Council or a judicial finding.<\/p>\n<hr style=\"margin-bottom:30px;\"\/>\n<h2>A template for objections offered to property owners<\/h2>\n<p>In February 2022, Avan\u00e7a Pratdip asks SOS Planas to circulate a template for individual objections. Property owners who wished to oppose the project could complete the document and submit it to the Town Council.<\/p>\n<p>The template repeats several of the arguments already raised in SOS Planas\u2019 administrative appeal. It also allows each owner to report a possible discrepancy between the surface area assigned to their plot in the project and its actual size.<\/p>\n<p>The document requests, among other things:<\/p>\n<ul>\n<li>that the property owner\u2019s observations be added to the administrative file;<\/li>\n<li>that the surface areas and information relating to their property be checked;<\/li>\n<li>that the provisional charges be recalculated if an error is identified;<\/li>\n<li>that the project not be granted final approval in the form presented.<\/li>\n<\/ul>\n<hr style=\"margin-bottom:30px;\"\/>\n<h2>Property owners join the legal challenge<\/h2>\n<p>The campaign continues throughout 2022. On 24 September, SOS Planas holds an extraordinary general meeting to allow <span class=\"accentue\">32 property owners who were not members of the association<\/span> to participate in preparing a challenge before the administrative courts.<\/p>\n<p>An email sent on 30 September also states that 36 property owners had contributed financially to preparing the proceedings. The available documents do not make it possible to establish with certainty the exact relationship between these two groups.<\/p>\n<p>The administrative court proceedings are subsequently registered before Administrative Court No. 2 of Tarragona under case number <span class=\"accentue\">367\/2022-E<\/span>.<\/p>\n<p>The court action therefore continues the challenge initiated at the end of 2021 against the PAU-4 economic reparcelaci\u00f3n project.<\/p>\n<p class=\"signature\">Jim &#8211; La Tribune de Planas<\/p>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][\/et_pb_section]<\/p>\n","protected":false},"excerpt":{"rendered":"<p>At the end of 2021, the PAU-4 economic reparcelaci\u00f3n project for Planas del Rey once again becomes the subject of dispute.
