It formally opposes the new reparcelaci\u00f3n project.<\/p>\n<p>As a reminder, our association \u00ab <span class=\"accentue\">Asociaci\u00f3n de Vecinos de Planes del Rei (SOSPlanas)<\/span> \u00bb filed on <span class=\"accentue\">December 29, 2021<\/span> a <a href=\"https:\/\/www.latribunedeplanas.com\/wp-content\/uploads\/2022\/02\/2021-12-29-recurso-de-alzada-alegationes-reparacelacion-2021-ayto-pratdip.pdf\" target=\"_blank\">recurso de alzada<\/a> with the Town Hall requesting:<\/p>\n<ul>\n<li><span class=\"accentue\">not to definitively approve<\/span> the reparcelaci\u00f3n project for the PAU4 zone;<\/li>\n<li><span class=\"accentue\">not to register it<\/span> with the Property Registry of Falset,<\/li>\n<\/ul>\n<p>due to the <span class=\"accentue\">omissions and legal errors<\/span> contained in the project.<\/p>\n<p><a href=\"#\">See and consult the Recurso de alzada here<\/a>.<\/p>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>A criminal complaint filed<\/h2>\n<p>Thanks to your many memberships, our lawyer filed a <span class=\"accentue\">criminal complaint<\/span> on <span class=\"accentue\">January 26, 2022<\/span> with the Investigating Judge of Reus against:<\/p>\n<ul>\n<li>the mayor of Pratdip, <span class=\"accentue\">Mr. Joan Rovira Vernet<\/span>,<\/li>\n<li>and the Town Hall secretary, <span class=\"accentue\">Ms. Izaskun Larroya Robert<\/span>.<\/li>\n<\/ul>\n<p>We will keep you regularly informed of the progress of these proceedings, which we hope will be <span class=\"accentue\">decisive<\/span>.<\/p>\n<p>On behalf of the <span class=\"accentue\">Asociaci\u00f3n de Vecinos de Planes del Rei (SOSPlanas)<\/span><br \/>\nPresident, G\u00e9rard Marais<\/p>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>How to submit your objection<\/h2>\n<p>Below you\u2019ll find the <span class=\"accentue\">objection letter<\/span> to complete and submit to the Town Hall:<\/p>\n<ol>\n<li><a href=\"https:\/\/www.latribunedeplanas.com\/wp-content\/uploads\/2022\/02\/2022-02-04-alegaciones-proyecto-reparcelacion.pdf\" target=\"_blank\">Print the objection letter<\/a><\/li>\n<li>Fill it in with your information (name, address, property number, etc.)<\/li>\n<li>Send it to someone currently in Planas who can kindly deliver it in person to the Town Hall of Pratdip.<\/li>\n<\/ol>\n<p>This person will receive a <span class=\"accentue\">registration number<\/span> and an <span class=\"accentue\">official receipt<\/span> confirming the objection was properly submitted.<\/p>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>Translation of the objection letter<\/h2>\n<p><span class=\"accentue\">STATEMENT:<\/span><\/p>\n<p>As an interested party in the above-mentioned administrative procedure, and in accordance with Articles 119 and related provisions of the <em>Recast Text of the Catalan Urban Planning Law (Law 3\/2012)<\/em>, I hereby submit, without prejudice to further arguments during the hearing process, the following <span class=\"accentue\">objections<\/span>:<\/p>\n<h3>I \u2013 Formal objections<\/h3>\n<p>The 15-day deadline given to submit these observations contradicts Article 119.2.c of the Catalan Urban Planning Law, which requires a 30-day period. This time limitation violates the right to a fair defense for all affected parties.<\/p>\n<h3>II \u2013 Specific objections<\/h3>\n<p>Regarding my property (Finca Registral n\u00ba\u2026 of Pratdip), the area listed as \u201ctaxable surface\u201d is \u2026 m\u00b2, while the actual surface is \u2026 m\u00b2. This discrepancy affects both the provisional and final payment calculations.<\/p>\n<h3>III \u2013 General objections<\/h3>\n<p><span class=\"accentue\">1.<\/span> The new reparcelaci\u00f3n project has not been approved by <span class=\"accentue\">any legal entity<\/span> representing the property owners (neither EUCC, nor a community of owners, etc.). Yet, the <span class=\"accentue\">EUCC was dissolved<\/span> by a ruling from the TSJC on July 21, 2016, due to the inaction of the Town Hall, which never even carried out its legal liquidation. This negligence has caused serious harm to the property owners.<\/p>\n<p><span class=\"accentue\">2.<\/span> The amount referred to as \u201cprovisional settlement\u201d is deliberately misleading. It attempts to validate a 2009 project that, due to municipal negligence, was never executed. The new cost estimate increases its value by more than 20\u202f%. This amount, intended for registration in the Falset Land Registry, <span class=\"accentue\">should be subject to a full Town Council vote<\/span> and approval by the majority of property owners.<\/p>\n<p><span class=\"accentue\">3.<\/span> The project includes cadastral parcel <span class=\"accentue\">3741626CF2434S0001AB<\/span> (see administrative file no. 125\/2021), consisting of green areas and public services <span class=\"accentue\">already received by the Town Hall<\/span>.
