However, according to the <span class=\"accentue\">decree-law of July 1990<\/span>, this conservation entity could only last for <span class=\"accentue\">five years<\/span>.<\/p>\n<p>In July 2016, the High Court of Justice of Catalonia (TSJC), relying on this law, declared the entity <span class=\"accentue\">illegal<\/span> and ordered its dissolution.<\/p>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>Institutional discrimination since 1993<\/h2>\n<p>The logic of the law was clear: at the end of those five years, in 1993, the Pratdip Town Hall should have:<\/p>\n<ul>\n<li>dissolved the EUCC; and<\/li>\n<li><span class=\"accentue\">fully integrated the urbanisation of Planes del Rei<\/span> into the municipality.<\/li>\n<\/ul>\n<p>Instead, successive municipal teams have <span class=\"accentue\">deliberately maintained discrimination<\/span> between residents of Pratdip centre\u2014mostly native Catalans\u2014and those of Planes\u2014mostly of foreign or non-Catalan Spanish origin.<\/p>\n<p>In a <a href=\"https:\/\/baixcampradio.com\/podcast\/informatius\/junts-x-cat-pratdip-guanya-amb-majoria-absoluta\/\" target=\"_blank\">radio interview with Radio Ciutat<\/a>, you yourself made disparaging remarks towards these &#8220;residents from below,&#8221; implicitly describing them as second-class citizens.<\/p>\n<p>By maintaining this situation, the municipality has violated <a href=\"https:\/\/fra.europa.eu\/fr\/eu-charter\/article\/22-diversite-culturelle-religieuse-et-linguistique\" target=\"_blank\">Article 22 of Title III<\/a> of the Charter of Fundamental Rights of the European Union, which prohibits all discrimination among citizens.<\/p>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>An illegal and discriminatory double taxation<\/h2>\n<p>Since 1993, residents of Planes have been subjected to <span class=\"accentue\">double taxation<\/span>: on one hand, the <span class=\"accentue\">IBI<\/span> collected by the Town Hall; on the other, the <span class=\"accentue\">fees charged by the EUCC<\/span>.<\/p>\n<p>This double taxation is prohibited by <span class=\"accentue\">European regulations signed by Spain<\/span>. It now exists only in certain authoritarian countries targeting religious or ethnic minorities.<\/p>\n<p>Over a period of 23 years, from 1993 to 2016, this system enabled the misappropriation of more than <span class=\"accentue\">11 million euros<\/span>:<\/p>\n<ul>\n<li>\u20ac5,750,000 in IBI<\/li>\n<li>\u20ac5,290,000 in subsidies from the Vandell\u00f2s nuclear power plant (zone 1C)<\/li>\n<\/ul>\n<p>These amounts should have been allocated to the <span class=\"accentue\">maintenance<\/span> and <span class=\"accentue\">nuclear compliance upgrades<\/span> of Planes del Rei. They were not.<\/p>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>Serious consequences for residents<\/h2>\n<p>The municipality\u2019s negligence has led to major harm:<\/p>\n<ul>\n<li>Since October 31, 2017, the sewage treatment plant has been out of service: <span class=\"accentue\">wastewater is being discharged into the Rio Llastre<\/span>, just above aquifers supplying Miami Platja and Hospitalet de l\u2019Infant.<\/li>\n<li>The lack of street lighting increases insecurity.<\/li>\n<li>Basic public services are not being provided.<\/li>\n<li>The <span class=\"accentue\">property value<\/span> of homes has plummeted due to the legal uncertainty maintained by your refusal to apply the rulings of the TSJC and the Generalitat.<\/li>\n<\/ul>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>Our demands<\/h2>\n<p>Given this situation, we demand:<\/p>\n<ul>\n<li>the <span class=\"accentue\">immediate provision<\/span> of basic public services in Planes, funded by the IBI paid by its residents (\u20ac250,000\/year);<\/li>\n<li>the <span class=\"accentue\">effective integration<\/span> of Planes into the municipality of Pratdip, in accordance with the July 21, 2016 ruling;<\/li>\n<li>the <span class=\"accentue\">implementation of renovation works<\/span> and nuclear compliance ordered on July 20, 2016, funded by the nuclear plant subsidy (\u20ac230,000\/year);<\/li>\n<li>the <span class=\"accentue\">full reimbursement<\/span> of unlawfully collected sums from 1993 to the present.<\/li>\n<\/ul>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>If ignored, we will appeal to European courts<\/h2>\n<p>If you fail to respond, we will file legal action before:<\/p>\n<ul>\n<li>the <span class=\"accentue\">Court of Justice of the European Union<\/span> (CJEU),<\/li>\n<li>and the <span class=\"accentue\">European Court of Human Rights<\/span> (ECHR),<\/li>\n<\/ul>\n<p>with the risk that Spain and the Generalitat will be convicted for violating European commitments and citizens&#8217; fundamental rights.<\/p>\n<p>Sincerely,<\/p>\n<p><span class=\"accentue\">G\u00e9rard Marais<\/span><br \/>\nOn behalf of the association \u201cVecinos de Planes del Rei\u201d (SOS Planas)<\/p>\n<p>[\/et_pb_text][et_pb_text admin_label=&#8221;Texte-Lien&#8221; module_class=&#8221;txt-article&#8221; _builder_version=&#8221;4.27.4&#8243; text_font=&#8221;|300|||||||&#8221; header_font=&#8221;||||||||&#8221; header_2_line_height=&#8221;1.2em&#8221; header_3_font=&#8221;||||||||&#8221; header_3_line_height=&#8221;1.3em&#8221; header_4_text_align=&#8221;center&#8221; custom_padding=&#8221;30px||||false|false&#8221; hover_enabled=&#8221;0&#8243; text_line_height_tablet=&#8221;&#8221; text_line_height_phone=&#8221;1.3em&#8221; text_line_height_last_edited=&#8221;on|desktop&#8221; header_2_font_size_tablet=&#8221;&#8221; header_2_font_size_phone=&#8221;&#8221; header_2_font_size_last_edited=&#8221;on|phone&#8221; header_3_font_size_tablet=&#8221;&#8221; header_3_font_size_phone=&#8221;23px&#8221; header_3_font_size_last_edited=&#8221;on|desktop&#8221; locked=&#8221;off&#8221; global_colors_info=&#8221;{}&#8221; sticky_enabled=&#8221;0&#8243;]<\/p>\n<p><a href=\"https:\/\/www.latribunedeplanas.com\/en\/sentence-of-the-superior-court-of-justice-of-catalonia\/\">-Read also: The court rules: the EUCC of Planas del Rey should have been dissolved since 1995<\/a><\/p>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][\/et_pb_section]<\/p>\n","protected":false},"excerpt":{"rendered":"<p>In 1987, the Pratdip Municipal Council decided to create the EUCC of Planes del Rei.
