These rulings reminded that certain services, such as <span class=\"accentue\">drinking water<\/span> and <span class=\"accentue\">waste collection<\/span>, fall exclusively under municipal responsibility. Nevertheless, the local authorities chose not to comply with these rulings.<\/p>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>1. The ruling of January 25, 2008: the court annuls the water and waste quotas<\/h2>\n<p>Following a complaint by a resident of Planas, <span class=\"accentue\">G\u00e9rard Fenouillet<\/span>, the <span class=\"accentue\">High Court of Justice of Catalonia<\/span> partially annulled the decisions made by the EUCC during its assembly on <span class=\"accentue\">October 6, 2004<\/span>.<\/p>\n<p>The court ruled that:<\/p>\n<ul>\n<li>The <span class=\"accentue\">urban quotas<\/span> decided by the EUCC, including the fees related to <span class=\"accentue\">drinking water<\/span> and <span class=\"accentue\">waste collection<\/span>, were <span class=\"accentue\">null and void<\/span>, as these services do not fall under its competence.<\/li>\n<li>These services must be provided and invoiced by the <span class=\"accentue\">Pratdip Town Hall<\/span> as a <span class=\"accentue\">public service<\/span>.<\/li>\n<\/ul>\n<p>However, the court did not annul all of the EUCC&#8217;s decisions nor did it force the Town Hall to proceed with the <span class=\"accentue\">official reception<\/span> of the urbanisation.<\/p>\n<p><a href=\"https:\/\/www.latribunedeplanas.com\/wp-content\/uploads\/2008\/01\/2008-01-31-sentence-fenouillet-agua-basuras.pdf\" target=\"_blank\" rel=\"noopener\">Ruling of January 25, 2008<\/a><\/p>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>2. The enforcement order of July 19, 2010: a Town Hall that refuses to comply<\/h2>\n<p>Two years after this ruling, the <span class=\"accentue\">Contentious-Administrative Court of Tarragona<\/span> found that:<\/p>\n<ul>\n<li>The <span class=\"accentue\">illegal quotas<\/span> had not been refunded to property owners.<\/li>\n<li>New bills continued to include charges for <span class=\"accentue\">water<\/span> and <span class=\"accentue\">waste<\/span>, in violation of the court ruling.<\/li>\n<\/ul>\n<p>The court therefore ordered:<\/p>\n<ul>\n<li>The <span class=\"accentue\">Pratdip Town Hall<\/span> to formally identify the body responsible for executing the ruling.<\/li>\n<li>The <span class=\"accentue\">EUCC<\/span> to provide the full identity of its board members.<\/li>\n<li>The <span class=\"accentue\">immediate<\/span> and complete enforcement of the 2008 ruling.<\/li>\n<\/ul>\n<p><a href=\"https:\/\/www.latribunedeplanas.com\/wp-content\/uploads\/2008\/01\/2010-07-22-sentence-executoire-fenouillet-agua-basuras.pdf\" target=\"_blank\" rel=\"noopener\">Ruling of July 19, 2010<\/a><\/p>\n<hr style=\"margin-bottom: 30px;\" \/>\n<h2>3. A confirmed lack of enforcement<\/h2>\n<p>Despite these clear orders, the case reveals that the <span class=\"accentue\">Pratdip Town Hall<\/span> and the <span class=\"accentue\">EUCC<\/span> have never complied with these court decisions.
