On 12 April 1988<\/span>, Pratdip Town Council formally approved the deed establishing the Urban Development Conservation Entity of Planas del Rey, generally referred to by the acronym EUCC.<\/p>\n

The deed of incorporation had been signed a few months earlier, on 28 July 1987<\/span>, before notary Inmaculada Nieto Aldea.<\/p>\n

The municipal certificate also includes an important condition: within a maximum period of two years, the compulsory transfers required under the Land Act were to be processed in favour of Pratdip Town Council.<\/p>\n

\n

An EUCC formally approved by the Town Council<\/h2>\n

The certificate was issued by Gloria Sabat\u00e9 Sabat\u00e9, acting secretary of Pratdip Town Council, following the plenary session held on 12 April 1988.<\/p>\n

In it, the Town Council resolves to approve the deed establishing the EUCC of the Planes del Rei development<\/span>.<\/p>\n

The document therefore confirms that the creation of the entity was not solely an initiative of the property owners, but was formally approved by the municipality.<\/p>\n

\n

A maximum period of two years to process the compulsory transfers<\/h2>\n

The municipal approval is subject to an explicit condition.<\/p>\n

The certificate states that, within a maximum period of two years<\/span>, the compulsory transfers required under the Land Act must be processed in favour of Pratdip Town Council.<\/p>\n

This provision is particularly important for understanding the role originally envisaged for the EUCC and the relationship between the development and the municipality.<\/p>\n

However, the certificate does not specify the exact list of assets, land or infrastructure concerned by those transfers. It therefore does not, by itself, establish that all roads, networks or facilities were automatically to be taken over by the Town Council within that period.<\/p>\n

\n

A structure intended to form part of a transitional stage<\/h2>\n

The condition imposed by the Town Council shows that the creation of the EUCC formed part of a wider urban planning process.<\/p>\n

The entity was intended to take responsibility for the upkeep and operation of the development while progress was made on the transfers required under planning legislation.<\/p>\n

The two-year period stated in the certificate also indicates that the situation was not envisaged as a completely open-ended arrangement with no time horizon.<\/p>\n

\n

An EUCC that would remain in place far beyond that period<\/h2>\n

In practice, the Planas del Rey EUCC continued to operate for many years beyond the two-year period mentioned in the 1988 certificate.<\/p>\n

Over time, its continued existence, its powers, the fees paid by property owners and the issue of the formal takeover of the infrastructure became recurring points of disagreement between the property owners and the municipality.<\/p>\n

The situation ultimately led to lengthy court proceedings and to the judicial dissolution of the EUCC in 2016<\/a>.<\/p>\n

\n

An essential document for understanding what followed<\/h2>\n

The certificate dated 12 April 1988 is an important document in the administrative history of Planas del Rey.<\/p>\n

It establishes two specific facts: Pratdip Town Council formally approved the deed establishing the EUCC<\/span>, and it made that approval conditional on the compulsory transfers required under the Land Act being processed within a maximum period of two years.<\/p>\n

The document should therefore be read as one stage in the urban planning procedure of the time, without attributing to it legal consequences that it does not expressly state.<\/p>\n
