This means that:<\/p>\n<ul>\n<li><span class=\"accentue\">The EUCC was effectively dissolved<\/span> as of that date.<br \/>\n(This is what our lawyer, Ma\u00eetre Barquin, has always argued, especially when he stated that from that day on, the property owners <span class=\"accentue\">were no longer required to pay any charges<\/span>.)<\/li>\n<li><span class=\"accentue\">The EUCC automatically becomes a liquidation entity<\/span>.<br \/>\nThe town hall <span class=\"accentue\">has no decision to make in the municipal council<\/span>: it is no longer up to them. They must simply <span class=\"accentue\">assume the legal consequences<\/span> of this dissolution \u2014 or instruct their lawyers to do so.<br \/>\n(Instead of paying them <span class=\"accentue\">\u20ac20,000 to \u20ac30,000 per year<\/span> to try to <span class=\"accentue\">circumvent<\/span> this ruling\u2026)<\/li>\n<hr style=\"margin-bottom:30px;\"\/>\n<h2>Municipal decisions now invalid<\/h2>\n<p>The ruling of 12\/12\/2017 nullifies several municipal acts, including <span class=\"accentue\">the October 2016 decree<\/span> in which the town hall claimed that the EUCC could not be dissolved until the ruling of 20 July (on reurbanization\/reparcelling) had been implemented.<\/p>\n<p><span class=\"accentue\">This reasoning is false<\/span>. It is now <span class=\"accentue\">null<\/span> and <span class=\"accentue\">void<\/span>.<\/p>\n<hr style=\"margin-bottom:30px;\"\/>\n<h2>The town hall can no longer avoid responsibility<\/h2>\n<p>Since 21 July 2016, <span class=\"accentue\">the town hall has been legally responsible<\/span>. There is no legal vacuum: even without the EUCC, <span class=\"accentue\">the municipality is obliged to provide minimum services<\/span> to its residents. This is a legal obligation.<\/p>\n<p>If it fails to do so, <span class=\"accentue\">it is acting illegally<\/span>.<\/p>\n<p>It is exposed to <span class=\"accentue\">criminal prosecution<\/span> or, at the very least, <span class=\"accentue\">administrative fines<\/span>.<\/p>\n<p>Our lawyer, <span class=\"accentue\">Ma\u00eetre Barquin<\/span>, recommends <span class=\"accentue\">filing a complaint for each failure<\/span> by the town hall to provide minimum services (water, roads, street lighting, etc.).<br \/>\nHe is convinced that <span class=\"accentue\">after ten fines<\/span>, the municipality will cease its delaying tactics.<\/p>\n<hr style=\"margin-bottom:30px;\"\/>\n<h2>Time to break free from resignation<\/h2>\n<p>We, the residents of Planas del Rey, have been accustomed to an unjust situation for far too long.<br \/>\nBut today, we must realize that: <span class=\"accentue\">even if the town hall continues to claim that we are a private urbanization, it has the legal duty to provide basic public services<\/span>.<\/p>\n<p>And if it refuses, <span class=\"accentue\">it will be held accountable<\/span>.<\/p>\n<hr style=\"margin-bottom:30px;\"\/>\n<h2>Two rulings, two separate obligations<\/h2>\n<p>The TSJC judges have always made it clear to Ma\u00eetre Barquin:<\/p>\n<blockquote><p>\n<span class=\"accentue\">Both rulings (that of 21 July and that of 20 July) must be applied separately<\/span>.\n<\/p><\/blockquote>\n<p>In other words, <span class=\"accentue\">regardless of the outcome<\/span> of the appeal still pending before the Supreme Court in Madrid concerning reurbanization, <span class=\"accentue\">the town hall will have to carry out the works, but without reinstating the EUCC<\/span>.<\/p>\n<p>So <span class=\"accentue\">without the \u201cconvenio\u201d<\/span> that required property owners to finance 100% of the works.<br \/>\nBecause <span class=\"accentue\">the EUCC is definitively dissolved<\/span>.<\/p>\n<p>And the town hall \u2014 along with its lawyers \u2014 must <span class=\"accentue\">fully assume the consequences of this situation<\/span> without further delay.<\/p>\n<p class=\"accentue\">G\u00e9rard Marais<br \/>\nAssociation de Vecinos Les Planes del Rei (SOS Planas)<\/p>\n<p>[\/et_pb_text][et_pb_text admin_label=&#8221;Texte-Lien&#8221; module_class=&#8221;txt-article&#8221; _builder_version=&#8221;4.27.4&#8243; text_font=&#8221;|300|||||||&#8221; header_font=&#8221;||||||||&#8221; header_2_line_height=&#8221;1.2em&#8221; header_3_font=&#8221;||||||||&#8221; header_3_line_height=&#8221;1.3em&#8221; header_4_text_align=&#8221;center&#8221; custom_padding=&#8221;30px||||false|false&#8221; text_line_height_tablet=&#8221;&#8221; text_line_height_phone=&#8221;1.3em&#8221; text_line_height_last_edited=&#8221;on|desktop&#8221; header_2_font_size_tablet=&#8221;&#8221; header_2_font_size_phone=&#8221;&#8221; header_2_font_size_last_edited=&#8221;on|phone&#8221; header_3_font_size_tablet=&#8221;&#8221; header_3_font_size_phone=&#8221;23px&#8221; header_3_font_size_last_edited=&#8221;on|desktop&#8221; locked=&#8221;off&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<p><a href=\"https:\/\/www.latribunedeplanas.com\/en\/sentence-of-the-superior-court-of-justice-of-catalonia\/\">-Read also: The court rules: the EUCC of Planas del Rey should have been dissolved since 1995<\/a><\/p>\n<p><a href=\"https:\/\/www.latribunedeplanas.com\/en\/here-what-the-judges-of-the-higher-court-of-justice-of-catalonia\/\">-Read also: Here what the judges of the Higher Court of Justice of Catalonia<\/a><\/p>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][\/et_pb_section]<\/p>\n","protected":false},"excerpt":{"rendered":"<p>In its ruling of 12 December 2017, the judge in Tarragona states a fundamental point: the judgment of the High Court of Justice of Catalonia (TSJC) has been fully enforceable since 21 July 2016.
